Sahara boss Subrata Roy sent to police custody till March 4

Sahara chief Subrata Roy pleaded before the court to be allowed to stay at home, which was denied.
NEW DELHI/LUCKNOW: Sahara chief Subrata Roy has been sent to police custody on Friday by the chief judicial magistrate Anand Kumar Yadav's court till March 4. Earlier in the day, amid high security, Roy was taken to the court from Sahara Sahar by Uttar Pradesh Police, several hours after he "surrendered" and was arrested at his home.

Roy pleaded before court to be allowed to stay at home.

His convoy exited at about 5.15pm from the rear gate to give a slip to the large number of media persons who had been camping there since Friday morning.

There was heavy deployment of police force and Provincial Armed Constabulary personnel at the main gate of the Sahara Sahar.

Roy was arrested in the morning after having evaded for two days a non-bailable warrant issued by the Supreme Court for his failure to appear before it in a case of non-refund of Rs 20,000 crore to investors.

TOLLGATE: Pressure on Chavan to scrap booths with eye on elections

Mumbai: Pressure is building on chief minister Prithviraj Chavan to remove toll booths in and around the metropolis if he is serious about providing relief to the aam admi, a day after he declared that he was prepared to amend the policy.

A senior bureaucrat said if Chavan, public works minister Chhagan Bhujbal and Maharashtra State Road Development Corporation chairman Jaidutta Kshirsagar are keen to provide relief to people, they must initiate steps for the removal of booths at Mulund, Airoli, Vashi, LBS Marg and Dahisar.

“The government must initiate steps for the removal of booths. It must negotiate with the entrepreneur, who has the contract for collection of toll. Pay him the entire amount of Rs 3,000 crore and remove the booths, it will help the ruling party in the Lok Sabha polls,’’ the bureaucrat said.

Mumbai Entry Point Limited managing director Jayant Mhaiskar said the proposal was acceptable. “No doubt, we will have to examine if there is a buy-back clause, but I am ready for an agreement in larger public interest,’’ Mhaiskar told TOI.

He said they entered into an agreement for maintenance of 27 flyovers in and around Mumbai and setting up of infrastructure projects at a cost of Rs 2,100 crore, and in lieu secured a contract for collection of toll at the five booths. “It’s a publicprivate partnership project. We have been given rights for collection up to 2026. If the government feels the contract should be terminated, it should pay us Rs 3,000 crore,’’ Mhaiskar said.

Mhaiskar, who was never called by Chavan for negotiations or a discussion on the agitation launched by MNS, said the government can provide relief to people if it accepts the Madhya Pradesh model. “There is no toll for private vehicles on twolane roads; only commercial vehicles have to pay in MP,’’ he said.

Mhaiskar said it appeared the agitation was against government policy and not against an individual developer. “The PPP model has been accepted all over. The state government will not abolish it,’’ he said.

A senior NCP minister said Chavan had to draft a plan for abolition of booths at least in and around Mumbai, or the Congress would have to pay a heavy price in the Lok Sabha and assembly polls. “Funds can be mobilized from Mhada or MMRDA, which have surplus,” he said.

Cop who makes 51k a month worth 40crore

Inspector Was Busted For 15,000 Bribe
As a police inspector, Mahendra Chavan (48) makes Rs 51,000 a month. That he has three bank accounts with Rs 16 lakh in deposits can be explained by smart investments. That he has two cars and has liquor worth Rs 30,000 in the bar can be explained by considering him to be a man of taste who knows his priorities. What cannot be explained, and what has the police searching for answers, is that he owns property worth over Rs 40 crore.

Chavan, an officer at the Ulhasnagar police station, was caught by the anti-corruption bureau (ACB) four days ago for accepting a bribe of Rs 15,000. There are other sordid details about him. The ACB said he is a loan shark: the bureau has learnt of at least two people who took Rs 16 lakh from him at very high interest rates. It said he is also a sex pest.

Chavan comes from a middle class family; his wife is a homemaker and they have two school-going children. The ACB raided his home in Varap village, Titwala, and found proof of assets far beyond his known sources of income. They include documents proving he owns 187 guntha, or over 18,918 sq m, in Kalyan, Titwala and Ulhasnagar. The properties are worth over Rs 40 crore, said experts. “Because of a boom in the area, property rates are very high. The cost of one guntha in places like Maharal and Varap on Murbad Road can vary in the Rs 10-30 lakh range,” said Ashok Jadhav, an agent.

Inspector Vaidya of ACB, Thane, said the bureau is yet to reach the exact valuation for the properties, “but yes, the price of land in those areas is very high and what Chavan owns may cost several crores of rupees”.

An ACB source said a preliminary probe suggests that Chavan bought property with ill-gotten money. “He comes from a very ordinary background and is the only earning member in his family.”

On sex complaints against Chavan, an officer said, “At least eight women have complained against him, claiming that he sexually abused them when they went to lodge cases at his police station. We have recorded the statements of three of the women. We will submit a report on the matter to the Thane police commissioner, who can then have an FIR filed under sections 354 (sexual assault) and 509 (words, gestures or act intended to insult the modesty of women) of the Indian Penal Code against Chavan.”

Seeks Tax Waiver, But HC Says Astrology His Job, Must Pay Dues
Mumbai: In 2001, when Kerala-based astrologer Unnikrishna Panicker predicted that J Jayalalithaa would become Tamil Nadu chief minister, many found it hard to believe. Though Jayalalithaa herself could not contest as she was debarred due to criminal cases pending against her, the AIADMK won the assembly election and she was made the chief minister as a non-elected member of the assembly.

Panicker’s prediction did not go unnoticed by Jayalalithaa’s supporters and he was given Rs 10 lakh for correctly forecasting her victory.

But it is this money, which Panicker claimed was a gift, that has landed Jayalalithaa’s favourite astrologer in the income tax net.

Panicker claimed that the money he received did not fall under the definition of business income and hence, should be exempted from tax.

In the assessment year 2002-03, Panicker had filed return of income disclosing a turnover of Rs 2.67 lakh.

After claiming various expenses, he declared Rs 1.89 lakh as income from his profession. In his statement, Panicker said he had received Rs 10 lakh as contribution from “certain persons” and sought exemption.

Panicker also said he had letters from those persons stating they made the contributions because they were happy about the outcome of the assembly elections and were grateful to him. But this did not convince the taxmen, and the income tax appellate tribunal estimated the tax liability to be around Rs 3 lakh.

Panicker moved the Kerala high court against the tribunal’s order. Last month, the high court rejected his petition and said the income that he received was part of his business and he has to pay tax for it.

“The assessing officer proceeded on the basis that the assessee (Panicker) had rendered certain services in the form of performing poojas and further procedures. This, according to the assessing officer, has to be treated as an income from business. As without rendering service, there was no question of assessee getting such amounts from the persons alleged to have given such amount,” the high court ruled.

Panicker, from Parappanangadi in north Kerala’s Malappuram district, boasts of a marquee clientele that includes corporate honchos and politicians. It was on his advice that Jayalalithaa donated an elephant to the Guruvayur temple in Kerala after the 2001 assembly elections. In 2002, he was also conferred ‘Jyothisha Puraskar’ by Chennai-based Swathithirunal Kalakendram.

Housing scam in Powai uses CM’s name

Mumbai: The state has ordered an inquiry into a bogus scheme orchestrated by unknown developers for affordable housing in Powai, inviting applications from the public for flats allocated at cheaper rates using the name of the chief minister.

The applications had been distributed to people who gathered at Mantralaya on Tuesday to submit them. The forms were reportedly addressed to CM Prithviraj Chavan requesting him to allocate the flat in the said scheme at an affordable rate of Rs 54,000 for a 400 sq ft flat. The state issued a statement making it clear that the applications are bogus.

“A bogus application has been prepared addressed to the CM in the name of Powai Area Development Scheme for affordable housing. There is no such government scheme. The police have been asked to make an inquiry,” the statement said.

At 7,000 crore dues, LIC is India’s top tax defaulter

Ex-J’khand CM Madhu Koda, With 103Cr, Named In Individual Category
New Delhi: Life Insurance Corporation (LIC) of India, the country’s largest insurer, has over Rs 7,000 crore in tax demand pending against it. This makes it the biggest tax defaulter in the country. Among other defaulters are Aditya Birla Telecom, Vodafone Infrastructure and Bharat Petroleum, data given by the income tax department under RTI showed.

The list of top 10 pending tax demands in each category was given to activist Subhash Agrawal in response to his RTI application seeking the list of top tax defaulters.

The tax demand raised by the department against LIC is for the assessment year 2010, which is pending “as on date”, the response furnished on January 27, 2014, said.

In the companies category, the top slot was given to LIC, which also had the biggest pending tax demand in all the other categories, according to the RTI reply. The demand against LIC was Rs 7,027 crore, followed by Aditya Birla Telecom (Rs 2,372 crore), Vodafone Infrastructure (Rs 2,038 crore), Idea Cellular (Rs 1,517 crore ) and Bharat Petroleum (Rs 1,494 crore ).

Other companies with pending tax demand include Nerka Chemicals (Rs 1,354 crore), Tamil Nadu State Marketing Corporation (Rs 1,234 crore), Andhra Pradesh Beverages Corporation (Rs 1,228 crore), HDFC Bank (Rs 1,051 crore) and IndianOil Corporation (Rs 874 crore).

In the individual category, those with pending tax demand included Sanjay Singal (Rs 280 crore), followed by Sukesh Gupta (Rs 155 crore) and former Jharkhand CM Madhu Koda (Rs 103 crore).

“This is to state that this office is only having a list of wherein demand is pending as on date... Now how many or which of the demand comes or not comes under a particular section wherein the assessee is deemed to be in defaulter, such linking is neither available nor possible to be collated by this office,” additional I-T director Ashish Abrol said in the response.

The ‘trust’ category is led by Mumbai Metropolitan Region Development Authority, with pending tax demand of Rs 654 crore, followed by the Jamsetji Tata Trust (Rs 290 crore), the Board of Control for Cricket in India (Rs 167 crore), Credit Guarantee Fund Trust for Micro and Small Enterprises (Rs 162 crore), NEIA Trust (Rs Rs 83 crore), UP Forest Corporation (Rs 51 crore) and Divya Yog Mandir Trust (Rs 41 crore), among others.

New Delhi:Continuing its offensive against industrialist Mukesh Ambani, the Aam Aadmi Party (AAP) on Thursday charged the UPA with turning a blind eye while his company — Reliance Industries — allegedly indulged in money laundering and goldplating profits acquired through the KG Basin gas project.

AAP leader and senior Supreme Court lawyer Prashant Bhushan also claimed that Union oil minister Veerappa Moily was in “Ambani’s pocket” and was pliable to do his bidding. He alleged that Moily had, in fact, continued to demand the extension of a “tainted” officer as chairperson of ONGC despite negative vigilance reports.

Elaborating on the “money-laundering” charge, Bhushan said the government had chosen to ignore a letter written by its high commission in Singapore in August 2011, pointing out that Rs 6530 crore had come to India from BioMetrix Marketing Ltd, a one-room company in Singapore that did not do any business. The asset-less company was responsible for the single biggest FDI in India and the money had been invested in Reliance group of companies, including Reliance Gas Transportation which is 100% owned by Ambani, he alleged.

The Commission’s letter also pointed out that the owner of BioMetrix was Atul Shanti Kumar Dayal. Bhushan said Dayal was a “front” for Reliance since he was a director in several of its companies.

In a statement, Reliance Industries said the allegations were “highly defamatory, false, irresponsible and devoid of any merit or substance whatsoever. These false allegations have been repeatedly made and their regurgitation in the media is fuelling an orchestrated, politically-motivated campaign against us”.

The party also accused Moily of seeking an extension for ONGC chairman Sudhir Vasudeva, who is to retire on Friday, and claimed he was appointed by the government despite the Central Vigilance Commission (CVC) rejecting his clearance twice.

“CVC had pointed out that apetition relating to KG basin was pending in the high court and that the CVC itself had sought a report from the ministry on these issues,” Bhushan said.

“But Moily overruled the CVC and sought to give him (Vasudeva) an extension against the said recommendation without a vigilance clearance,” he said.

Sahara chief goes missing as UP cops turn up at doorstep

Lucknow: A 12-member Lucknow police team on Thursday spent over two hours in Sahara Shaher to arrest business magnate Subrata Roy, only to emerge out of his palatial bungalow to tell the media that he could not be found.

The Supreme Court had on Wednesday ordered a non-bailable warrant against the Sahara group boss in a case involving the refund of over Rs 20,000 crore to investors after he failed to appear before it, citing his mother’s ill health.

The police also visited the medical facility in Roy’s house where his 92-year-old ailing mother, Chhabi Roy, is undergoing treatment for various ailments, but failed to find
him there too.

Will arrest Sahara chief the moment he is traced: Police
Lucknow: A police officer who was part of the team that went searching for Subrata Roy on Thursday told news agencies that though the Sahara boss had told the Supreme Court through his lawyers that he wanted to be by his mother’s bedside holding her hand, he was nowhere to be found in the hospital that she is undergoing treatment.

The police then informed his brother J B Roy, who was present there, about the purpose of their visit and left. The entire search operation was videographed by the team. SSP Praveen Kumar confirmed the police team could not find Roy at Sahara Shaher in Vipul Khand, Gomtinagar, his residential address mentioned in the NBW.

“But we are on the lookout,” Kumar said, adding police teams were keeping a close watch on two other locations for Roy, but refused to elaborate. The officer further said there were certain conditions in which the police usually arrest a person against whom an NBW has been issued. “But (in Roy’s case) we won’t take any chances at all and arrest him the moment he is traced,” SSP Kumar said.

The search operation generated a great deal of curiosity with media crew and outdoor broadcast vans converging outside the towering gates of the palatial 225-acre premises at 3.45pm.

A posse of private guards allowed only cops to enter Sahara Shaher, with the media being kept out. Two hours later, the police team walked out with the officers looking to evade the media, in vain. Inspector Ajit Chauhan then told reporters that he was there to serve the SC-mandated NBW on Roy. “We could not find him inside though we searched the premises,” he said, adding that the next course of action would be decided by senior officers.

SSP Kumar said he was confident that the police would be able to produce Roy before the apex court on March 4.

Sahara chief Subrata Roy surrenders in Lucknow

NEW DELHI: Sahara chief Subrata Roy surrendered on Friday in Lucknow and was taken into custody by the UP Police.

Senior advocate Ram Jethmalani informed the Supreme Court that Subrata Roy had surrendered in Lucknow.

The apex court, meanwhile, declined to constitute a bench of Justice K S Radhakrishnan and JS Khehar to urgently hear Subrata Roy's plea for recalling the arrest warrant.

SC told Roy's counsel that it would not be possible to constitute the bench at short notice for hearing his application, in which he tendered unconditional apology for absenting himself on Febuary 26.

The Sahara chief may remain in police custody till March 4, when he is to be produced in the apex court.

The surrender comes a day after UP Police team on Thursday led a raid in Lucknow to arrest the Sahara chief.

The police team did not find the Sahara chief at his residence.

Subrata Roy's son addressed a press conference announcing that Sahara chief had surrendered willfully.

He also informed that the Sahara chief would be moving again for relief from Supreme Court.

Earlier on Friday, Subrata Roy said that he was not absconding from arrest and was ready to "unconditionally follow" whatever direction the Supreme Court gives him.
