Chit Fund Means in India : Few Points about Scam of Lakhs of Crores

“Why Government is not nabbing all the directors of errant companies, who fled away with poor people’s hard earn money?  They all should be behind the bars first, same as in the case of Sahara India, then start recovery process.” Virendra Pandey, Chief Promotor, Yuva Shakti Pratishthan

Mr. Virendra Pandey : A Crusader To Stop The Chit Fund Menace

Mr. Virendra Pandey wrote an article, in which he is questioning to the government for recovery of poor citizen’s money looted by the chit fund companies of India. He emphasis on size of the scam not only in the financial aspects but huge hawala transactions and black money generated and stashed abroad. He also says that government should form an SIT and investigate this scam. Here is the full article:

Illegal CIS Menace
I have come to know that general public and small / medium investors invested their hard earned money in various “quick earn and quick make rich schemes” with higher returns and various incentive promised by companies for promoting products / services wherein a person has to become a member / agent or in other words buy a product to become an agent (interpreted by different names by different companies) and make more members under them and sell the company’s products / services as it was sold to him for which he is offered a hefty commission and incentives thus expanding their tentacles faster and raking in money in hundreds and thousands of crores through MLM / network marketing route and promoting themselves as sale/ purchase or service provider company and circumventing the law of CIS scheme.

After receiving various complaints, I conducted a detailed investigation through our financial and legal experts in the workings and financials claims done by various companies Like PACL, SAIPRASAD GROUP, SAIPRAKASH GROUP, SAMRUDDHA JIVAN Etc. and we have come to the conclusion that there are huge financial irregularities running into thousands of crores and all the claims made by your company through the directors and agents are absolutely false baseless and frivolous.

Do PACL has 60 Lakhs 43 Thousand 388 Sq. Acras Land Bank?
We, gave them an opportunity of being heard by sending notices through our advocates, but there was no reply from them till date we started submitting our finding with law enforcement agencies and now even Security and Appellate Authority has dismissed there claim and ordered PACL TO REFUND Rs. 49,100 CRORES to the 5.85 CRORES CUSTOMERS. Therefore a question arises if the PACL has collected money from 5.85 CRORES CUSTOMERS @ 7500/- per unit then where has the money gone because as per SAT order each customer will get only Rupee 839.31 that to I doubt if the company has sufficient asset to return it.

As per my calculations, if PACL handed over the 500 Sq. Yards land piece for Rs. 7,500 investment, and if there are 5.85 crores inventors, they must hold a land bank of approximate in the size of 29,25,00,00,000 Sq. Yards land. This is approximate 60 Lakhs 43 Thousand 388 Sq. Acras.

Tons of Questions, No Answers
I had asked how much land with clear marketable title is in possession of your company as on 31st December 2014 along with supported documents state wise.

I had asked how many plot holders do they have as on 31st December 2014 provide list State wise? Which now it is clear by the order of SAT that PACL has 5.85 crores.

PACL has collected more than Rs.40000 crores, I had asked PACL list of people from whom they had collected the amount state wise?

I had asked how many farm houses do PACL possess State wise details.

I had asked whether farm houses are operative?

I had asked why you take Power of Attorney from customer on blank paper.

I had asked why registration Letter, Allotment Letter etc. are issued on letter head of company, instead of any government letter or stamp paper?

I had pointed and demanded PACL company officials about their Auditor of your company has observed that there a discrepancies regarding title and ownership of land, requested give us complete list of such property.

I had requested the company to give us complete list of advances paid for purchase of land along with location of plot and owner/sellers/authorized persons, name to which advances have been paid.

I had asked why has PACL made investments in 100’s of companies like MDLR/ blue coast resorts etc which has no business revelation with the objectives of PACL and is nowhere mentioned in the j/v cum investment agreement of the investors/agent.

I had asked why has directors of PACL and subsidiary companies entered into 100’s of companies in which funds from PACL or its subsidiaries was infused or invested and after some time this directors got retired and went on in some other company doing the same modus-operandi, what is the status of funds which was invested into such companies as this invested funds were collected from lakhs of small and medium investors/agent from across the country in the name of j/v in property development business I shall now right to various law enforcement agencies to enquire the assets and properties of all the directors associated with PACL and its subsidiaries where they have entered and resigned.

I had asked to give us list of complete advances for purchase of land, which are doubtful in the opinion of your company auditor.

I had asked to give us list of loans and advances. Do you receive interest on such advances? Have you taken any permission for granting any such loan from the investors, if yes give us details?

I had asked Why PACL has paid commission and incentive in advance? Give us the complete list of commission and incentive paid in advances and purpose why it is given in advance? Also please provide us the copy of TDS deducted by PACL from the commissions and incentives paid.

Fooling Government and Investors in the Name Of Development of Land
I had further observed that PACL give’s service of development, maintenance, custodian caretaker of the plot which you allot to its investors/agent at a price with a guaranteed high returns thus providing your expertise as service to your clients and do any sale why you should not be termed as service provider and government should not collect service tax from you?

Why Fund Transfer to Australia?
It was further noticed by me that huge amount of funds was transferred to Australia without the permissions of the investors/agents of company thus indulging into illegal trade practice and also may be money laundering.

Where is the Land?
As per the opinion report submitted by my financial expert I doubt that the company does not have sufficient clear marketable land as it shows in the books of account and as shown that they have allotted.

Fake Land Dealing by Company
I have sufficient proof that you have indulged into fabricating of fraud property documents through your front people and office bearers to purchase fraudulently force fully properties and register properties in Raigad district by producing dummy vendor?
I think that by playing the number game of companies and rotating funds from one company to another company and further in some other company you have purpose fully tried to siphoned thousands of crores of hard earned invested funds of the investors/customers/agents and may have transferred it to Australia by illegal means.

I also found that the advances for purchase of land to the tune of Rs1484.63 crores have been paid which seems to be doubtful in nature. Please provide the necessary documents of the parties to whom the advances where paid and for which land??

In the opinion taken their financial experts they have found out that a total amount of 2892.99 crores have been invested in a shady manner my client would like to know the details of investment, name and address of parties to whom the funds were given and purpose of transaction?

Let’s end the Chit Fund menace… Let’s begin the war against financial loot by the crooks in the disguise in the corporate companies.

Chit Fund Scam: Odisha ex-AG held

Mohanty was arrested from his Cuttack residence in connection with a land deal

The CBI today arrested former Advocate General Ashok Mohanty in connection with the chit fund scam case  and took him on two day remand after producing him in the special chief judicial magistrate court here.

The  CBI counsel had sought a three-day remand while Mohanty’s counsel had moved a bail petition.

Earlier during the day, Mohanty was arrested from his Cuttack residence in connection with a land deal he had done with AT group chief Pradip Sethy. He was brought to the CBI office and questioned before being taken for medical examination and later to the court.

Mohanty  was  questioned on his purchase of a house in Cuttack from Sethy for Rs 1.01 crore in 2013. The payment made and the bank account etc.

Reliable sources said the bank transaction did not reflect the entire amount. Further, the charge is that the former AG had misused his official position in entering in to the transaction with Sethy when he was already facing a police case in the ponzi scam.

Mohanty , known to be a upright person who did not even have a house at Cuttack till he purchased one from Sethy, however said his conscience is clear. “I have complete faith in God and my ‘guru’. Truth shall prevail, I have acted in good faith and I hope people will retain the trust and confidence in me that they have had all these years”.

It may be recalled that Mohanty had been interrogated by the CBI on 13 September. He had insisted that he paid Rs 1.01 crore for the house in CDA and that it was no favor of gift.

True to his character Mohanty had resigned from the AG post after the general elections.

The CM Naveen Patnaik had not accepted his resignation till 12 September, when Mohanty received summons from the CBI.

Significantly, Mohanty’s arrest evoke sharp dissent from lawyers as well as administrative circles here.

Members of the Bar Council decried the arrest. If the CBI claims to have prima facie evidence based on documents, it cannot be tampered with, secondly no witness can be intimidated or gained over nor can a person of Mohanty’s stature abscond , so where is the need for arresting him, said lawyers of the High Court Bar.

The arrest s totally unwarranted, the CBI could have named him in the charge sheet and the court summoned him, they said.

A large section of the people from all walks of life in Cuttack and Bhubaneswar expressed dismay over the arrest.

BJD MP Bhartruhari Mahatab who represents Cuttack LS constituency said the CBI seems to be in the habit of trying to be in the new always by conducting such arrests. It is unwarranted, I know Mohanty since decades, said Mahatab. His party , however, tried to distance itself from Mohanty saying it was a ‘personal party’ not involving the party or the government.

The Opposition Congress and BJP said the government cannot shirk its responsibility. The particular purchase of house by Mohanty had been raised in the Assembly by the Opposition but at that point in time the government ignored it and the police never took any action, charged BJP state president K V Singh Deo.

What was the police doing for the whole of last year when it was investigating the chit fund scam, he asked, implying that the BJD had tired its best to cover up involvement of party leaders and other funcationaries.Speculations are that the CBI will interrogate a few senior police officers and bureaucrats.

THE MEGA Rs 23,000 crore 4G SCAM BY the GOVERNMENT AND RELIANCE

AAP alleged another scam
After the 2G spectrum allocation scam during the former UPA government, another major telecom scandal in the allocation of 4G spectrum (Broadband and Wireless Access - BWA) ) has now been exposed in its latest report submitted by the Comptroller & Auditor General (CAG) to the central government.

According to the information available so far, this scam has caused a loss of around Rs 23,000 crore to the public exchequer in the initial estimates and this amount will definitely go up in case a thorough and impartial probe is ordered by the Narendra Modi government.

The Aam Aadmi Party demands that the BJP-led NDA's central  government should  immediately cancel the telecom license and allotment of 4G spectrum given to Reliance Industries and also order a CBI probe for a through criminal investigation into this scam involving Reliance Industries and the UPA government.

If the NDA government delays tabling of the CAG report on the 4G spectrum & BWA allocation scam and does not cancel its allotment, it will become clear that this government also is favouring corporates and allowing them to loot national resources.

The details of this scam are as follows:

The UPA government in March 2013 allowed a back-door entry of Reliance Jio Infocomm into voice telephony in violation of the judgment of the Supreme Court in the 2G case. This was done at the price discovered in 2001 of Rs 1,658 crore for a pan-India licence, which is the same price that was struck down by the Supreme Court in its 2G judgment, because that had caused a huge loss to the public exchequer.

During May-June 2010 the auctions for 3G and 4G were concluded. The 3G auction fetched Rs 16,750.58 crore for 5+5 MHz spectrum in 2100 MHz (or 2.1 GHz) band. Thus, per MHz, the price worked out to be Rs 1,675 crore. Immediately, after the 3G auction, the 4G auction began which fetched Rs 12,847.77 crore for 20 MHz pan-India license in the 2300 MHz (or 2.3 GHz) band. This works out to be Rs 642.39 crore per MHz.

This was so because all documents stated that 4G spectrum was for data services only, whereas 3G spectrum can be used for both data and voice telephony. (All relevant documents - including the CAG report, Reliance Jio Infocomm reply and Department of Telecom response are attached with this press release).

Infotel Broadband Services Pvt Ltd (IBSPL) emerged as the only company to have acquired pan-India 4G spectrum. IBSPL had an internet license since November 2007 and had just one subscriber with revenue of Rs 16.28 lakhs during 2009-10, and its authorized share capital was Rs three crore and the paid up capital was Rs 2.51 crore. Infotel Digicomm Pvt Ltd (IDPL) held 99.99% share of the IBSPL at the time of submission of application in March 2010.

Within hours of completion of 4G auction on 11.06.2010, IBSPL increased the authorised share capital from Rs three crore to Rs 6,000 crore. On 17.06.2010, the company authorized its Board of Directors to allot Rs 475 crore equity share of Rs 10 each to Reliance Industries Ltd (RIL) and 25 crore equity share of Rs 10 to Infotech Digicomm Pvt Ltd (IDPL) aggregating to the equity capital of Rs 5,000 crore. On the same day, the company also decided to change from a private company to Public Limited Company (Infotel Broadband Services Ltd). Thus, the company within a week of winning the 4G spectrum disposed off 95% shares to RIL while 5% was retained by IDPL. Much later in March 2013, the company was renamed as Reliance Jio Infocomm Pvt Ltd.

CAG has found that the Government did not protect its interest at the time of framing eligibility criteria for the 4G auction. It allowed participation of internet (ISP) licensees without ensuring adequate safeguards in terms of net-worth of the companies participating in the auction. It found that while a UAS licensee or even a new company without a license was allowed to participate in the 4G auction, but
they had to pass through the test of net-worth in order to become eligible, but no such criteria was specified for the existing internet (ISP) licensees participating in 4G auction. CAG observed that this criterion was important even for ISP-A licensees as they had to participate in the bidding where the reserve price was fixed at Rs 1,750 crore per pan-India license for 20 MHz spectrum in 2.3 GHz band.

The only company which won the pan-India 4G license, was an ISP-A licensee, Infotel Broadband Services Pvt Ltd (IBSPL), a HFCL promoted group company. CAG has stated that IBSPL was given the ISP-A license in November 2007, and it had just one leased-line subscribers as on December 2009 and total revenue of just Rs 16.28 lakh for FY 2009-10. The paid-up capital was just Rs 2.51 crore and 99.99 per cent of it was held by Infotel Digicom Pvt Ltd at the time of submission of application for the 4G auction in March 2010. Thus, this company could not be termed as a serious player. And there were no checks in-built in the auction process to eliminate such non-serious players, CAG has observed.

After the company was taken over Reliance Industries, the government allowed it to provide voice telephony (which was earlier prohibited) without conducting a fresh auction. This was done at the rate of Rs 1,658 crore which was fixed in 2001, and had been struck down by the Supreme Court in the 2G case for causing huge loss to public exchequer. The CAG has now concluded that besides vitiating the auction process, an undue advantage of Rs 22,842 crore was given to RIL at the cost of exchequer. The relevant part of the CAG’s report is reproduced below: -

It was found that the basis of the decision i.e. payment of entry fee of Rs 1,658 crore by ISP licensee for a permission to Pan India provision of mobile voice services using BWA spectrum considered by the DoT Committee, Telecom Commission and the MOC&IT, was primarily intended to fill the gap between the eligibility criterion stipulated for participation in the 3G / BWA auction in 2010 as UAS / CMTS licensees had paid entry fee of Rs 1,658 crore while ISP licensees had paid only Rs 30 lakh.

The DoT Committee, Telecom Commission and the Ministry of communication &IT  however ignored the fact that the quantum of entry fee i.e. Rs 1,658 crore was basically discovered in 2001 through the bidding for the 4th Cellular licenses. Market conditions since then have changed drastically, and this price needed to be modified to reflect the present value.

Neither the DoT Committee / TC under the Chairmanship of the Secretary DoT nor the ministry felt the need for revision of the price discovered in 2001 as the entry fee for UASL in 2013, even when the Hon’ble Supreme Court of India had cancelled 122 licenses granted in 2008 on the basis of the same entry fee stating that it was impossible for them to approve the action of the DoT.

Therefore, by permitting ISPs to provide mobile voice service using BWA spectrum won in 2010 auction post-auction, the government has brought ISP licensees with BWA spectrum at par with UAS / CMTS 3G spectrum winners so far as provision of services are concerned – Voice, Data, etc., and post auction interpretation of such vital nature would appear to be arbitrary, inconsistent and not appropriate.

Hence, IBSPL, now Reliance JioInfocomm, appeared to have been accorded undue advantage of Rs 22,842 crore i.e. the difference of the proportionate prices for 20 MHz block size in 2.1 GHz spectrum band (3G spectrum) and 2.3 GHz spectrum band (BWA spectrum) plus the Net Present Value of the entry fee for UASL at the end of FY 2009-10 (Rs 20,653 crore plus Rs 3,847 crore - Rs 1,658 crore). Besides, the sanctity of the entire auction process has been rendered vitiated due to post auction interpretations and interventions after three years. It was therefore no surprise that Reliance JioInfocomm was among the first group of companies which applied for UL immediately after introduction of the scheme and obtained the Letter of Intent (LoI).

Had the spectrum blocks been specified and declared as liberalised spectrum blocks i.e. open for all technology / services in the NIA in February 2010, there was no doubt that bidders would have taken informed decision for putting up their bid and the market discovered price would have been significantly different for 3G and BWA spectrum.

AAP leader and senior lawyer Prashant Bhushan has filed a PIL in the Supreme Court seeking cancellation of Reliance Industries’ telecom license and a through criminal investigation. Supreme Court had issued notice to the government and Reliance on that petition on 9th May 2014.

Helicopter Purchase Scam: NCP Against Sacking Goa Guv

The NCP today opposed Goa BJP's demand to sack state governor B V Wanchoo stating that no action can be initiated against him in the helicopter purchase scam unless the CBI comes out with specific findings involving him in the case.

"Why should he be asked to resign ? He is just being questioned by CBI. Let them (CBI) come with some findings against him before asking him to resign. BJP is trying to run their political agenda through this demand," NCP Goa Spokesman Trojano D’Mello told reporters here today.

The Goa unit of BJP on Monday had demanded Wanchoo's resignation for being investigated in the AugustaWestland VVIP chopper purchase issue. The CBI intends to question Wanchoo as a witness in the case.

The party had demanded that the governor should step down, or be sacked, if he refuses to quit voluntarily.

"The sudden outburst of the BJP demanding resignation of the governor is a clear indication that the party has lost confidence in Prime Minister Narendra Modi. This also indicates that BJP has not overcome the hangover of being an opposition party," he said.

"What does the local unit of BJP has to do with it ? Let Prime Minister and Central Cabinet take a decision on it. If the BJP is really worried about tainted people in power, they should sack two of its state ministers against whom chargesheets are filed in the courts," D'Mello said.

State Tourism Minister Dilip Parulekar and State Sports Minister Ramesh Tawadkar have been chargesheeted in different cases before the court, and their trial is pending.

MASSIVE CHIT-FUND FRAUD BY PUNE BASED SAI PRASAD GROUP

Despite the Madhya Pradesh High Court order, two orders of SEBI and more than seven FIRs in various states, Pune based Sai Prasad group had the temerity  to run their chit fund racket without any hindrance.

On 27th March, 2014, the district & session court of Thane (Maharashtra) issued an Inquiry Order against M/s. Sai Prasad Foods Limited/ Sai Prasad Properties Limited and its promoters and directors, Mr. BalasahebBhapkar, Mrs. VandanaBhapkar and ShashankBhapkar. On the basis of that order Nagar Police Station of Thane City has registered an F.I.R. (No. 62/2014) and initiated investigation into the matter.
In July 2013, the Securities and Exchange Board of India (SEBI) had passed two orders against both the companies of Sai Prasad group and restrained them from collecting money from the public. (Click the below link to see the detailed order):
SEBI’s Order against M/s. Sai Prasad Properties Limited;
SEBI’s Order against M/s. Sai Prasad Properties Limited;

In 2012, Madhya Pradesh High Court had ordered Central Bureau of Investigation (CBI) to conduct investigation against Sai Prasad Group and other similar nature companies, on the basis of that the CBI had conducted an investigation and revealed its findings as stated below:
“It is clear that the companies used to receive deposits from the citizens by floating various types of plans viz. installment plan and lump-sum payment plan against the sale of land units, plants and that of livestock. The companies entered into contract with the investors and they have committed offences under section 3 (1), 3 (2) and 3(4) of Madhya Pradesh NiveshkokeHitonKaSanrakshanAdhiniyam 2000, Sec, 58B (5 and 5A), and 58 of the RBI Act, 1934, and Sec. 4, 5, and 6 of the Prize Chits and Money Circulation Schemes (Banning ) Act, 11978 and Sec. 420 of Indian Penal Code.” (Click the below given link to read an Order of MP HC)
Similarly more than seven criminal cases have been registered against M/s. Sai Prasad Foods Limited/ Sai Prasad Properties Limited and its promoters, directors, agents and branch managers in various states. Details of few cases are as under;
F.I.R.No. 15/12,Banswqada Police Station, Rajasthan
F.I.R.No. 136/13,Talcher Police Station,Odisha
F.I.R.No. 114/13,Ainthpali Police Station,Odisha
F.I.R.No. 635/13,Sikandarabad Police Station, Dis.Bulandshahar,UP
F.I.R.No. ***/**, Kanpur Police, UP
M/s. Sai Prasad Foods Limited/ Sai Prasad Properties Limited and its sister concerns indulge in fraudulent fund mobilization rackets. They violate various rules, regulation and sections of the Securities and Exchange Board of India Act, 1992 by running “Collective Investment Schemes” illegally without permission of SEBI. They also violate the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, Maharashtra Protection of Interests of Depositors (In Financial Establishments) Act, 1999 and Rules, and Indian Penal Code, the Companies Act, 1956 and the Reserve Bank of India Act, 1934.

The promoters and directors of the company are projecting that M/s. Sai Prasad Foods Limited/ Sai Prasad Properties Limited and its sister concern companies are involved in business of sale purchase of land and foods products and are earning huge profits. But in fact, in the garb of projecting various business modules, they are luring innocent and uneducated people by offering heavy returns to invest their hard earned money in all the fake and bogus entities of Sai Prasad Group.
SAI PRASAD GROUP is paying heavy commission to their agents and middle men plus huge returns to investors, which is commercially not viable in such types of businesses. The group is claiming that they are paying heavy returns out of company's heavy profit, but in fact they are paying amount to an old investor, which they collect from the new investor and thereby circulating the money amongst the investors. These types of business practices creating criminal liabilities are punishable under the provision of and regulation of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, Maharashtra Protection of Interests of Depositors (In Financial Establishments) Act, 1999 and Rules, and Indian Penal Code.
Sai Prasad group is running joint ventures. But none of the investors get any land in return. They are in fact happy to get the money at the end of the maturity period. When the cycle of payments stops, the hard-earned money of the uneducated villagers will go down the drain.
The Sai Prasad Group had recruited around 12 lakh commission agents of various ranks, to lure the investors.  They are working part time/full time and convincing small investors by offering heavy returns. Agents of the group systematically join hundreds of investors in their unit and motivate them by giving a speech during a function or meeting organized at different venues.
Agents have received healthy commission including gifts like two-wheelers and even four-wheelers for recruiting people to join the scheme.
Court orders and investigations have failed to hinder the activities of Sai Prasad group in running their illegal chit fund scheme. Their Ponzy scheme is one such scheme.
Alert citizens should lead the way in creating awareness about this fraud and prevent innocent or ill-advised people from joining this chit fund.

(F.I.R.No. 62/2014,Nagar Pol.Stn.

M-Sat finds Satyam fraud began in 2002

The multi-thousand-crore-rupees accounting fraud at the erstwhile Satyam Computer Services Ltd by its ex- chairman B. Ramalinga Raju dated back to 2002, much further back than earlier thought.
Investigations carried out by Mahindra Satyam (M-Sat), which took over Satyam Computer Services Ltd in April, 2009, revealed this fact.
The investigating team noted that there were certain transactions which were either improperly recorded or remain unrecorded. There was no proper information about fictitious transactions to the tune of Rs 1,122 crore prior to 2002, as a result of which it was shown as net opening balance as on April 1, 2002. It was classified as " unexplained differences suspense account," in the assets and liabilities statement.
The fraud committed by Satyam's founder and ex- chairman B. Ramalinga Raju and his team was exposed in the restated audit report of M- Sat for the years 2008- 09 and 2009- 10, which was approved by the board of directors of the company on Wednesday.
An independent forensic team appointed by the new management had to struggle a lot to unearth the fraud. " It was the most challenging task. The forensic team had to do 100 types of investigations, go through 2,70,000 files running into 30 terabytes, decode the secret data gathered from 300 hard disks seized from the erstwhile promoters, study one billion lines of secret transactions and examine 200 bank accounts to dig out the scam," M- Sat chairman Vineet Nayyar said.
These include fictitious accounts in revenue receipts, interest income, exchange fluctuations, salary, other expenses, bank borrowings and interest, and tax payments. The total extent of fraudulent entries had an impact of Rs 6,800 crore on the profit and loss account of M- Sat.
For instance, the fictitious revenue from April, 2002, to September, 2008, was Rs 5,353 crore, generated by creating 7,500 inflated invoices and circumventing the normal revenue recognition cycle. This was followed by showing fictitious cash collections as collections from customers. In order to substantiate these fictitious collections, forged bank statements and fixed deposit ( FD) receipts were also prepared.
Of the total fictitious revenue shown, about Rs 4,870 crore was translated into fictitious cash and bank balances. Similarly, fictitious interest income recorded from 2002 to 2008 was Rs 899 crore, of which Rs 327 crore was translated into fictitious cash and another Rs 197 crore was recorded as withholding tax on such interest income.
The remaining Rs 375 crore was reflected as accrued interest as on September 30, 2008.
The forensic investigation also exposed the record of Rs 206 crore towards fictitious exchange gains, which resulted in fictitious debtors of Rs 18 crore and balances of Rs 188 crore. It revealed that Raju had knocked away Rs 293 crore as net salary costs, which were not recorded in the books of accounts, resulting in fictitious cash and bank balances of Rs 299 crore.
What is more, during the scam period, Raju and his team had borrowed Rs 720 crore from banks, but there are no loan records. The company had effected unrecorded repayments to the extent of Rs 581 crore. The unrecorded interest expenses in respect of such accounts amounting to Rs 17.5 crore also resulted in fictitious cash and bank balances.
"The promoters showed fictitious tax payments ( advance tax and US federal tax) to the tune of Rs 306 crore. We have also noticed some entries and debits which we are unable to explain as they remain unidentified," Nayyar said.
The investigation has been unable to identity the nature of certain alleged transactions amounting to Rs 1,203 crore against which the firm had received notices from 37 firms.

Mumbai: Aarey road 'repaired' for 3rd time in 2 years

Work underway by PWD to fix the rugged road, which is usually repaired only in bits and pieces, and so falls apart in a month or so.

Hoping to gain some brownie points before the upcoming Lok Sabha elections, the public works department (PWD), headed by the Nationalist Congress Party (NCP), has once again started repairing the arterial Aarey Milk Colony Road. The work is expected to be complete before the polling day.

In the last one year the road, which connects Goregaon on the Western Express Highway (WEH) with Powai and Marol, has been patched up twice — before and after the monsoon. But it didn’t take more than a month for it lose shape, because the 8 km stretch is only patched up in spots to begin with, and the shoddy work ensures a bumpy ride for motorists.

When mid-day visited the road on Friday, we saw that the same stretch was being repaired by the PWD. Executive engineer Milan Kamble said, “We started repair work on the road over a week back, and it will be completed in less than one month. We usually do the repairs at the night to avoid interrupting traffic movement.”

Asked why the road needed fixing a third time in one year, he refused to comment. But a senior PWD official, requesting anonymity, said, “The Aarey Milk Colony Road is owned by Aarey Dairy, which, being a government body, gives us the money for repairs.

It requires overhaul time and again because it passes through a small patch of forest that receives heavy rainfall. Every time they give us a limited amount of money, and we can only repair the patches that are in bad shape. The solution to potholes is constructing a cement-concrete (CC) road.”

But the PWD proposal to build the main road of CC was turned down by a cabinet sub-committee on infrastructure in February, as some of the ministers thought it fell under the BMC’s jurisdiction, and the corporation should make the road and stop the toll collection later on.

Concrete plan

  • The PWD intended to convert the present tar road to CC and the project was worth R135 crore.
  • The related proposal stated that the main Aarey Colony Road connecting the Western Express Highway at Goregaon end with Powai and Marol would be made of cement-concrete and the internal road of asphalt.
  • At present, R5 is charged for two-wheelers and R15 for light utility vehicles using the road.

Indian ‘arms dealer’ on CBI radar held in UK in bribe case

New Delhi: Alleged arms dealer Sudhir Choudhrie and his son Bhanu were arrested in the UK on Wednesday for their alleged involvement in a bribery scandal involving Rolls-Royce company.

According to preliminary information, the Serious Fraud Office (SFO) of the UK is investigating allegations that Rolls-Royce, which makes aircraft engines and turbines, paid bribes in China and Indonesia to secure contracts, and that Choudhrie was the intermediary for the payments.

The SFO had on December 23 confirmed that its director had opened a criminal investigation into allegations of bribery and corruption at Rolls-Royce. The investigation took a dramatic turn on Wednesday with the arrest of Choudhrie and his son.

Choudhrie has figured in several major defence scandals in India, and was named in at least two FIRs filed by the CBI, and also in its list of about two dozen “undesirable contact men”, who are suspected of manipulating government contracts. Both the FIRs were closed by the CBI saying it had found no concrete evidence to take forward the case.

Choudhrie’s name has also figured in documents filed by Italian investigators into the VVIP helicopter scandal, in which former IAF chief S P Tyagi and his cousins are among those accused of taking bribes to clear the 2010 deal. In documents before courts, senior Finmeccanica executives have claimed that Choudhrie was their middleman for past arms deals in India, before they brought in new agents.

Choudhrie is also a major donor to the UK Liberal Democrat party, and was until recently among the probables to become a member of UK’s House of Lords.

British media reports said Choudhrie and his son Bhanu were arrested on Wednesday. A spokesman for the Choudhries told local media the duo denied all wrongdoing, and were fully cooperating with the investigation. The father-son duo was granted bail without conditions after being questioned for several hours.

Charges that Rolls-Royce paid bribes first emerged almost a year ago when a former employee of the company raised the allegation.

Choudhrie and his family have been living in Chelsea in London almost permanently since 2006, when he was named in CBI FIRs in India. He has at least one farm house and another independent house in Sunder Nagar in Delhi. Over the years, the Choudhries have built up a sprawling legitimate business in the UK, India and elsewhere.

File charges in 6 Coalgate cases: SC

New Delhi: The SC on Monday directed the CBI to file chargesheet in six cases relating to irregular allotment of coal blocks in which it has completed its probe. A bench of Justices R M Lodha, Madan B Lokur and Kurian Joseph gave the agency three weeks to file the reports.

The CBI, in its FIR, had alleged that JLD Yavatmal, to reinforce its claim for a block, had fraudulently claimed in its application that it was jointly promoted, controlled and managed by the Lokmat group and IDFC Ltd.

‘CBI can probe PSUs sans state nod’
New Delhi: The Supreme Court wants the CBI to file charges in six Coalgate cases. The CBI had filed an FIR alleging that JLD Yavatmal had fraudulently claimed to be promoted by the Lokmat group and IDFC Limited. While stating its net worth, it had allegedly added IDFC’s net worth of Rs 2,544.19 crore and the Lokmat group’s Rs 73.38 crore to its figures. The agency had said in its FIR that JLD Yavatmal would not have otherwise qualified for coal blocks. The company got coal blocks in Fatehpur east (Chhattisgarh).

The Jayaswal brothers — Manoj and Arvind — were named by the CBI in its FIR relating to the allocation of coal block which allegedly fructified after AMR Iron and Steel concealed and misrepresented facts that its group firms were already allocated coal blocks and that it was financially eligible to get the block.

The bench also asked the agency to wind up its investigations, which it has been monitoring for over a year, by April 30 and gave it a free hand to conduct probe against public sector undertakings in states. The court told the agency that it need not seek statutory consent of states to investigate PSUs located in their geographical jurisdiction. The CBI had informed the court that as many as nine states had refused consent in this regard.

When the court wanted to know the reason for the delay in the completion of investigation, senior advocate Amarendra Saran told it that the agency was awaiting response from various countries where letters rogatory had been sent. Saran said out of 169 companies under probe, field inquiry against 149 had been completed. However, in relation to one preliminary enquiry (PE-5) involving the role of 75 state and central PSUs in coal allocation, the CBI claimed that several states had refused to accord sanction to prosecute their officers. Section 6 of the Delhi Special Police Establishment Act requires the CBI to take prior sanction of the state/Centre to prosecute senior public servants.

As the court is monitoring the case, the bench directed the CBI not to await states’ consent.

Addl director appointment sparks row A controversy has erupted over the appointment of an additional director in CBI after the Centre and the Central Vigilance Commission(CVC) locked horns over the choice of an officer whose track record was under question.

The row centred around Archana Ramasundaram, who was appointed as additional director last week, after the CVC refused to send more than one name for the post. Sources in the government said that the Appointments' Committee of Cabinet (ACC) had asked for names from CVC, which decided to send only one name for the post despite receiving a panel of names of three officers from the DoPT. Ministerial panel recommends 26 coal blocks for deallocation

The coal ministry had last month served a fresh notice to allottees of 61 blocks that had not yet been developed

New Delhi: The inter ministerial panel looking into the status of development of captive coal blocks to private power and steel companies has recommended that 26 more such blocks be taken back.

A person in direct knowledge of the matter said this after the second day of the panel’s latest round of meetings. The panel reviewed 61 blocks on Friday and Saturday.

This person who did not want to be identified, however, did not specify which blocks were recommended for deallocation or which companies they had been allotted to.

The coal ministry had last month served a fresh notice to allottees of 61 blocks that had not yet been developed. The companies had been asked to revert by the first week of February.
These coal blocks were among those that were allocated between 1993 and 2010, and are being investigated by the Central Bureau of Investigation (CBI) as part of a Supreme Court-monitored probe.

CBI started probing allocations of coal mines after the Comptroller and Auditor General (CAG) of India, the government auditor, published a report in 2012 estimating a notional loss of Rs.1.86 trillion to the exchequer because of a flawed allocation process.
These 61 blocks were the ones in which either the first stage of environment clearances had not been obtained or which had not been explored or had only been partially explored at the time of allocation.

As per procedure, the panel’s recommendations are sent to the coal minister, who has to sign off on them before they take effect. The minister is, however, not bound by the recommendations.
In its 17 January notice, the coal ministry had said that such blocks would be taken back. The notice said that in case a block holder fails to furnish information by these dates, the ministry would take “appropriate decision based on the available information and material on record”.

Prominent allottees whose blocks were under review included Tata Steel Ltd, Tata Sponge Iron Ltd, Tata Power Co. Ltd, Jayaswal Neco Ltd, Jindal Steel and Power Ltd, Reliance Energy Ltd, Ultratech Ltd, Rungta Mines Ltd, Essar Power Ltd, Hindustan Zinc Ltd, Hindalco Industries Ltd, DB Power Ltd, Adani Power Ltd, Arcelor Mittal Ltd, GVK Power (Govindwal Sahib) Ltd, Bhushan Power & Steel Ltd, Monnet Ispat & Energy, Sterlite Energy Ltd, GMR Energy Ltd, Usha Martin Ltd, JSW Steel Ltd, Jaiprakash Associates Ltd, ACC Cement Ltd, Uttam Galva Steels Ltd, Adhunik Corp. Ltd and SKS Ispat and Power Ltd.

QNet: ED lodges money laundering case

Mumbai: The Enforcement Directorate (ED) on Wednesday registered a case under the Prevention of Money Laundering Act against marketing firm, QNet, Vihaan Direct Selling company, former world billiards champion Michael Ferreira and QNet’s office-bearer, Vijay Eswaran.

The economic offences wing (EOW) is already probing a cheating case and has arrested nine persons connected to QNet. Sources in the ED said it would investigate and attach properties under the Act if proved that the same were purchased from the proceeds of crime.

“Most of the money went abroad. The ED will focus on finding the money trail and the suspected hawala transactions,” said an officer from the security establishment.

QNet refuted these allegations. In a statement it said: “QNET as a matter of policy adheres to strong principles of legal business, transparency and corporate governance. All documentation pertaining to the operations of its Indian franchisee Vihaan Direct Selling (VDS) and its financial transactions have been provided to the investigators at the EOW.”—

Real estate firm directors booked for ‘cheating’ bizman of flat in Kharghar

Navi Mumbai: Acting on a court directive, the Kharghar police have registered an FIR against three directors of a Vashi-based real estate company on a businessman’s complaint that they were trying to cheat him of a flat he had booked in 2005.

A Panvel court passed the order in November on a criminal complaint filed by a Kopar Khairane resident, Manohar Kaka (51), earlier this year against Nalin Sharma, Suresh Patkar and Vijay Kadu of Sai Builders & Developers.

Kaka, who had filed a civil complaint in 2010 on the dispute, filed the criminal complaint following slow progress in the case.

Kaka said he had booked a flat in the developer’s 20-storey Yashvasin tower in Kharghar’s Sector 27 in December 2005. He alleged that he had paid Rs 19.46 lakh for the said flat but the developers were trying to sell the house to athird party at a higher price.

Kaka said that he paid the first instalment of Rs 51,000 for the flat in December 2005, when its price was about Rs 21 lakh. But he alleged that the builders demanded a booking amount of 50% of the flat’s price in 2007, in an attempt to cancel his allotment. The flat costs Rs 65-70 lakh now.

In their reply to the summons on Saturday, the builders said Kaka was misleading authorities. They said they had not encashed the last four cheques of Rs 2 lakh each given by Kaka in November 2009 as he had told them not to.

A spokesperson for Sai Builders & Developers told TOI, “Kaka has only paid Rs12.46 lakh since December 2005. We have issued him several reminders for payments for the 2-BHK flat he booked for a total cost of Rs 21.02 lakh. He defaulted in payments for which we sent him a flat cancellation notice in February 2009. We deny his allegations.’’ “We have not missed any hearing in the case. The 150 flats in the two wings of Yashvasin tower have sold out, only this one flat is in legal contention,’’ said a company official.

Apolice official confirmed that the FIR has been registered but said investigations would be made before further action is taken.

SpeakAsia scam: Second main accused arrested from Bangalore

Ram Niwas Pal, who helped launder funds, had been living under another alias
The New Delhi police have arrested another accused in the Rs2,200-crore Speak Asia scam, in which at least 24 lakh investors from across the country had been cheated.

Ram Niwas Pal, 40, was arrested from Bangalore, where he had been living under another alias. Ram Niwas was the one buying companies based abroad and making contacts to launder money through them. While in Bangalore, he had been developing a business plan for a Malaysia-based IT firm and trying to get a ‘Certification of Popularity’ for the online advertisement of various websites.

Over a decade ago, he was employed with the Indian Air Force and had faced court-martial for deserting the force without any intimation in 2001.

His brother, Ram Sumiran Pal, was arrested from Dehradun last week. The third main accused, Manoj Sharma, is at large.

After escaping from Mumbai, Ram Niwas stayed in Delhi after which he moved to Lucknow and then Bangalore. To conceal his identity, he managed to get fake identity proof under an assumed name, and also changed his appearance. He also cut off contact with his family, friends and acquaintances.

Speak Asia, an online survey marketing firm, sold web subscriptions for Rs11,000 each and in return, investors had to fill survey forms for multinational firms. It promised an annual payment of Rs 52,000. After paying few investors, Speak Asia folded up in India

After over two years of investigation, the Economic Offences Wing (EOW) of the Mumbai police has frozen more than 210 bank accounts containing over Rs142 crore, and another 150 accounts are under scrutiny.
The EOW has found a trail of over Rs 750 crore being laundered across various countries like Singapore, Dubai, Italy, UK and Brazil, among others.

According to the police, Speak Asia had remitted over Rs900crore to Singapore. “The money was sent from India to banks in Singapore and from there to Dubai, Italy and the UK. The money came back from the UK again to UAE (Dubai) and back to India,” according to a release issued by the Delhi police crime branch.

CM quota flats: HC warns state govt of contempt

The Bombay High Court Monday warned the state government of contempt proceedings if it failed to comply with its to submit a list of double allottees under the chief minister's discretionary housing quota.

The court observed the government had already taken several months to disclose the names of double allottees and sought compliance of its April 2012 order by December 6.

A division bench of Justice A S Oka and S C Gupte remarked, "You (state government) are supposed to submit a list and there's nothing secret about it. If the list is ready, show us the list."

Acting on a public interest litigation (PIL) filed by former journalist Ketan Tirodkar, the court had directed the government to submit a list of all double or multiple allotments of flats under the chief minister's discretionary quota.

Additional public prosecutor Aruna Kamat Pai informed the court that the state was ready with the list of allottees under the scheme, but could not disclose the names to the petitioner (Tirodkar). She added that the state government would file an affidavit regarding its stand.

Dissatisfied with the state government's approach, the court said it wanted compliance. "You have to comply with the order, failing which we will issue a contempt notice."

"You required so many months to comply? You must comply with the order by Friday," the court said.

Another petition filed by senior citizen Manohar Bait (66) claimed he had been eligible for allotment of a flat under the CM's quota since 1989, but his name remained on the waiting list of allottees over the decades. His lawyer Uday Warunjikar informed the court that as per Right To Information replies collected by Bait, most beneficiaries are either related to an MLA or MP or are political heavyweights.

The High Court will hear Bait's petition along with Tirodkar's PIL on Monday next.

Tirodkar, who had filed an RTI application seeking the information, said he had received the names of allottees from 1989 to 2010 but no details were furnished of those who had received more than one allotments.

In his PIL, Tirodkar stated that Public Works Department Minister Chhagan Bhujbal was allotted a 825-sq ft tenement in Pune in 1992 under the MLA quota, his nephew Sameer Bhujbal was awarded a 1,040-sq ft tenement in Sangamwadi, Pune, under the "intense need for space" quota that comprises 3.10 per cent of the 10 per cent discretionary quota of the CM.

Others named in Tirodkar's PIL include Pratap Pawar, brother of Union Agriculture Minister Sharad Pawar, Bhagvati Sharma, mother-in-law of former CM Ashok Chavan who was allotted a 800 sq m flat in Powai, son and daughter of BJP leader Prakash Jawdekar who were allotted separate flats in Mumbai, Tushar Khadse, son of Opposition leader Eknath Khadse, and Abid Hasan Mushrif, son of NCP leader Hasan Mushrif.

Names in PIL
*Sameer Bhujbal, nephew of Chhagan Bhujbal
* Pratap Pawar, brother of Sharad Pawar
* Bhagvati Sharma, mother-in-law of Ashok Chavan
* Son, daughter of Prakash Jawdekar
* Tushar Khadse, son of Eknath Khadse
