Rough Cop: Retired constable held for posing as cop, duping people

A retired head constable was arrested on Monday for duping people by posing as a cop. Baliram Pomaji Rathod (59), retired from duty a year ago.

The matter came to light in January, when a businessman complained that a policeman took Rs 2.85 lakh cash from him at Bhuleshwar.

“The complainant said, in January, a 'cop’ told him that there were riots in the lane. Rathod asked the victim to hand in all the cash to him, and then fled with the money. During the course of investigation, we found that the accused was an ex-cop,” said inspector Shrikant Desai, from the V P Road police station.

Rathod, a resident of Lamington Road Police Line, Grant Road, has been sent to police custody till June 22.

A case has been registered under IPC sections 170 (personating a public servant) and 420 (cheating). Rathod’s last posting was at Pydhonie police station, where he worked as a surveillance officer.

“Rathod has confessed of cheating many in a similar manner. He was identified in the CCTV footage, recorded near the Bhuleshwar area. That’s when we started a search for him. IPL Spot Fixing Scam: Betting should be made legal, says Vindoo Dara Singh

Actor Vindoo Dara Singh, who was arrested for betting in the Indian Premier League (IPL) and now on bail, says cricket betting should be legalised.

“Cricket is like a religion in India. The IPL will be conducted and betting will take place as well," said Vindoo on Monday.

Vindoo, who got bail on June 4, feels the government should legalise cricket betting.

“I think the government should interfere and legalise betting,” he said. At the same time, he has vowed not to watch cricket for the rest of his life. “I don’t know whether IPL 7 will happen or not. However, it does not matter to me,”said Vindoo, who maintains he is innocent.

“I can guarantee I have not done anything wrong. When I gain the trust of people, I will get more work. However, until then life will go on,” he said.

CCI MEMBERSHIP FRAUD : EOW arrests CCI’s IT officer

Assistant Manager confesses to crime, says CCI member Sandeep Jain is a key conspirator; Jain’s membership revoked

The Economic Offences Wing (EOW) of the Mumbai police on Monday arrested the assistant manager of the Cricket Club of India’s (CCI) IT department, who admitted to issuing club memberships to 11 people against dead members.

Khalid Kazi, the official, is the first of the CCI employees whose role is being probed in the membership scam. He had earlier applied for anticipatory bail, which was rejected. He was produced before a local court, which remanded him in police custody for five days.

Additional CP Rajvardhan of the EOW said Kazi’s interrogation would help unravel how the fraud was committed.

The CCI management had found Kazi guilty of tampering with membership data. An internal inquiry revealed that Kazi had received illegal gratification. Inreturn, he tampered with the evidence. “We have registered a case of impersonation, cheating and forgery of documents against Kazi,” said Assistant PI Tanvir Sheikh.

The club management suspected foul play when a few people, who earlier were not members, started using club facilities without being formally introduced. When questioned, they claimed to be wards of existing members. CCI members later discovered the suspects had been fraudulently introduced in the membership register.

Realising that such a fraud cannot occur without the go-ahead of club insiders, an internal probe was conducted where Kazi was found involved.

During the internal inquiry, Kazi said CCI member Sandeep Jain was a key conspirator. “Jain approached me two years ago. Initially, I rejected the offer, but he kept pursuing. I finally relented,” Kazi said.

The11 fraud members were asked to appear for an inquiry by CCI with supporting documents. However, no body showed up.

The CCI has also blocked Jain’s membership.

SEZ Tax Scam: HC upholds withdrawal of SEZ tax exemptions : Blow For Cos As They Need To Pay MAT, DDT

AVOIDING TAX BASE EROSION
Mumbai: The Karnataka high court has in its recent order upheld the imposition of Minimum Alternate Tax (MAT) on special economic zones (SEZ) developers and units operating in SEZ zones. It has also upheld the levy of Dividend Distribution Tax (DDT) on dividends declared by SEZ developers. These taxes were introduced for the SEZ units and developers by the Finance Act, 2011.

A bunch of companies having units in SEZs and SEZ developers such as MindTree, Biocon, Opto Circuits, Opto Infrastructure and Primal Projects, to name a few, had petitioned the Karnataka high court against the withdrawal of MAT and DDT exemption available to them earlier.

The petitioners claimed that they had made heavy investments and established units in SEZs or developed SEZs on the basis of the tax holiday benefits available, which included MAT and DDT exemption. Thus, withdrawal of the exemption was violative of various articles of the Indian Constitution. It was also violative of the Doctrine of Promissory Estoppel and Doctrine of Legitimate Expenses.

On enactment of the Budget proposals of 2011, both SEZ developers and units in SEZs were brought within the ambit of MAT, from the financial year 2011-12 onwards. Prior to such enactment, MAT exemption was available to them. The current rate of MAT is 20.96% and it is computed against book profits.

Earlier, SEZ developers did not pay DDT on dividend distributed by them. From June 1, 2011, dividend distributed by SEZ developers was covered by DDT which is currently 17%.

The Karnataka HC dismissed the petition on various grounds. It held that it is a settled position of law that every tax exemption should have a sunset clause. As the MAT and DDT exemption for SEZs did not have a sunset clause, the flaw was removed by an amendment made by the Finance Act, 2011. Second, these exemptions created an inequality between SEZ companies and other companies, which was removed by the amendment.

The HC pointed out that such exemptions also resulted in erosion of the tax base. It upheld the right of the government to make amendments to fiscal polices.

“The legislature can never be precluded from exercising its legislative power by resorting to the Doctrine of Promissory Estoppel,” added the HC.

The CFO of a software company said, “The order appears to be harsh and we are examining it. Business plans do take into account tax costs and the imposition of MAT on SEZ units is a huge burden.”

Rostow Ravanan, CFO, MindTree, which was one of the petitioners, said: “The verdict is disappointing. We are examining the available legal alternatives.”

Offshore Mining Scam: CBI closes probe into seabed mining licence

New Delhi: The CBI has closed its inquiry into alleged irregularities in allocation of offshore mining rights to companies for exploring minerals in the seabed of Bay of Bengal and Arabian Sea. Last September, CBI had started a probe into alleged favours extended to companies by officials of the Indian Bureau of Mines while awarding licences for the country’s first-ever attempt to explore untapped mineral wealth lying in the seabed.

CBI sources said it closed the inquiry as the matter was already under ‘judicial scrutiny’ and prima facie nothing malafide was found. They said they had given their recommendation to the Indian Bureau of Mines in this regard.

Sources, however, said in case the HCs, where the cases are going on, direct the agency to carry out a thorough probe, it will proceed. It was alleged that four beneficiary companies owned by family members of an Indian Revenue Service officer were under the agency’s scanner as they bagged nearly half of the blocks despite lacking necessary qualification, they said.

Sources claimed government had placed 62 blocks on offer out of which 28 were awarded to companies owned by family members of the IRS officer, who had also served in mines ministry. Each block measuring about 800 sq km is estimated to have huge unexplored mineral wealth in the seabed of Bay of Bengal and Arabian Sea.

The final award of licences had been put on hold after aggrieved parties approached the Bombay HC and the Andhra Pradesh HC seeking their cancellation.

Chit Fund Scam: Cops invested in Ponzi scheme to unearth fraud

Mumbai: Two officials of the economic offences wing (EOW) put money in MMMindia, also known as triple M, to uncover its fraudulent practices.

The firm allegedly cheated more than 70,000 people of nearly Rs 2,000 crore. No arrest has been made yet and the police have named 17 people, including five Russian nationals, as accused.

The complainant, a police officer, stated, “During an inquiry, I received a tip-off that MMMIndia would conduct a seminar in Dadar. I present at the event which was attended by 800 to 1,000 people from Mumbai, Navi Mumbai, Pune, Thane and Nashik. We recorded everything, including lectures by MMM members. There were speeches and a dance show.”

The “motivational” speech in Russian was delivered by Alexei Muratov and translated into English by Michel Gluing. An accused, Dinesh Kotian, translated the speech in Hindi, the police said. “I also came to know that the panel leaders and networkers in the scheme are also inducing people to invest money in the scheme by arranging meetings at various hotels and other places. Clips of such seminars have been uploaded on file-sharing and social networking sites. Thousands are falling prey to the fraud scheme,” a senior police officer said.

In May, the Assam police had arrested Muratov, Adery and their three Indian accomplices. The EOW has also obtained a transfer warrant for their custody. A team is likely to leave for Assam.

State orders clean-up after rap in food scam

Women’s Groups Allotted Contracts In Meal Scheme
Mumbai: Maharashtra government has entrusted the task of providing food to poor children and their mothers under the integrated child development scheme (ICDS) to women’s self-help groups at the tehsil level after a apex court-appointed panel made critical observations.

“In view of the commission’s stringent observations, we have asked tehsil-level selfhelp women’s groups to take up the job of providing food to poor children and their mothers. Contracts have been given in a large number of tehsils,” a senior official in the women and children development department told TOI on Tuesday. The bureaucrat said a high-level committee headed by the district collector has been set up in each district to monitor allotment of contracts and ensure that ICDS—the Centre’s flagship plan—is implemented in letter and spirit.

The apex court’s commissioner had appointed Biraj Patnaik to submit a status report on the implementation of take-home ration (THR) or supplementary nutrition programme for poor children, particularly in the tribal areas, in response to a PIL.

Earlier, the apex court had asked all the state governments that THR supply be done by local groups, gram panchayats, women’s selfhelp groups and mahila mandals. However, the court found that the specific guidelines had been violated.

In his report, Patnaik observed that there were blatant violations of the Supreme Court’s directives. “My investigation points to a close nexus between politicians, contractors and bureaucrats that has allowed for the active subversion of the letter and spirit of the apex court orders. As the documentation shows, this could not have been possible without complicity at the highest levels of governance in the state,” Patnaik stated in his 22-page report.

It was found that while a Rs 500-crore contract for supply of rations was awarded to three institutions, none of them had any production capacity of their own. “It was all in the family. All the three firms were controlled by five different families and selfhelp groups, mahila mandals or village communities were not visible at all,” the official said. The bureaucrat said in view of the SC’s observations and the Patnaik report findings, it was decided not to extend the contract of the three firms.

On November 5, 2012, when chief minister Prithviraj Chavan was apprised of Patnaik’s report, he had ordered a high-level inquiry over allotment of the Rs 500-crore contract. “We will conduct the probe within a month,” Chavan had told the media. According to reports, an internal probe by the women and child development department had revealed that there were violations of the apex court guidelines. It recommended to the government to terminate the contract with immediate effect. “The report was submitted, but we don’t know its status,” the bureaucrat said.

Coal Scam: CBI grills 2 ex-PMO staff, Nair up next

New Delhi:The CBI has questioned two former PMO officials to study procedures involved in coal block allocations in its bid to understand how much of Coalgate details reached PM Manmohan Singh’s desk. After examining the two officials—Vini Mahajan and Ashish Gupta—the

CBI is preparing to question TKA Nair, ex-principal secretary to PM. Nair held charge during the 2006-09 allocations and is currently adviser to the PM. The CBI has also summoned ex-coal secretary HC Gupta on Thursday.

JSPL, Tata get notice for sitting on blocks
New Delhi: The coal ministry has served notice to Jindal Steel and Power Ltd (JSPL), a company promoted by Congress MP Naveen Jindal, and Tata group joint venture Strategic Energy Tech Systems Ltd (SETSL) for squatting over prime coal blocks which are among the biggest mines in terms of reserves named in the federal auditor’s Coalgate report.

The ministry has given the companies 20 days to explain delays in achieving milestones in developing the blocks – JSPL’s Ramchandi I and SESTL’s Arkhapal Srirampur. SESTL is a joint venture between a consortium of Tata group firms and South Africa’s Sasol.

Both the blocks are in Odisha and were allotted in February 2009 for CTL projects that aimed to produce synthetic auto fuels from coal. The Comptroller and Auditor General, on the basis of ministry records, pegged the gross coal reserves of each mine at 1,500 million tonnes.

According to back-of-theenvelope calculations, the two blocks are good enough to produce 15,000 mw – or more than five times Delhi’s demand – for 25 years even if half the reserves are mined.

The notice to JSPL shows that the company has failed to achieve 16 out of 17 milestones stipulated in the allotment letter. The showcause to SETSL shows the company achieving only six milestones so far.

The companies had joined the CTL bandwagon during oil’s record run through 2008-09 when crude price saw a peak of $147 a barrel. But with subsequent decline in oil prices, CTL projects appeared less attractive. Reliance Industries Ltd too had applied for a block for the same project but did not succeed. South Africa is the pioneer in CTL technology and its application.

IPL spot-fixing: Ex-Ranji player questioned

Mumbai: The city crime branch on Monday grilled Chandresh Patel alias Chandbhai, a former Ranji player who was recently released on bail in the IPL spot-fixing case.

“We interrogated him as he was in touch with wanted bookies such as Jitendra alias Jitu Tharat and Pintu. We wanted to find out if he has any knowledge of their whereabouts,” said an officer. “We will summon him on Tuesday for another round of questioning. ”

A local court on Monday relaxed the bail restrictions imposed on accused Vindhu Dara Singh. The court had directed him to visit the crime branch office every alternate day.

The magistrate court agreed with his lawyer’s contention that as the offence was bailable, no restrictions could be imposed. TNN

‘Onus of clearing PF dues on fund panel’

Mumbai: The Regional Provident Fund Commissioner should take action against any company that has not deposited the dues of a beneficiary and try to recover the money, the state consumer disputes redress commission has said.

The regional PF commissioner’s office, absolving itself of any responsibility, had blamed Swan Mills for non-payment of dues to a Borivli senior citizen, fighting for his dues since 2005.

The commissioner and Swan Mills have been directed to pay Mulchand Shah Rs 1.52 lakh within four months along with a compensation of Rs 95,000 by the Maharashtra State Consumer Disputes Redressal Commission.

The panel, upholding a district forum’s order citing the EPF & Miscellaneous Provisions Act, said it was the commissioner’s duty to administer the fund with respect to every employee who comes under the Act.

‘PF office must act against errant cos’Mumbai: The state consumer disputes redress commission has ruled that it’s the regional provident fund commissioner’s duty to ensure an employee gets his dues.

“Merely issuing an order (to deposit the dues to the firm) did not solve the problem of the complainant, who is the ultimate beneficiary under the scheme,” it said.

In his complaint, Mulchand Shah had said he worked for Swan Mills from 1963 to 1998. A couple of years later, he filed a claim for his provident fund and on June 1, 2005, received a cheque for Rs 1.48 lakh. It was only a part of the money due to him. So, he filed a claim again, saying he was entitled to another Rs 1.52 lakh but did not receive it.

Aggrieved, he filed a complaint before a district consumer forum on June 23, 2009. In June 2011, the forum directed the regional PF commissioner and the company to pay Rs 1.52 lakh and a compensation of around Rs 95,000.

Soon after, the regional PF commissioner’s office filed an appeal in the state commission. It challenged the order, saying the company had failed to deposit the PF contribution for Shah. It claimed that the firm was guilty of deficiency of service, and the commissioner’s office was not liable to comply with order.

The state commission held that the district forum had rightly observed that according to the Employees’ Provident Funds & Miscellaneous Provisions Act, 1952, it was the commissioner’s duty to administer the management of PF in respect to each and every employee to whom the Act is applicable.

It added that when the commissioner failed to receive the company’s contribution, he could have taken action under the provisions of the Act and proceeded to recover the money. “On this count too, the opponent no. 1 (commissioner) has not adduced any evidence to establish that such action was ever taken,” the consumer panel added.
