ADARSH CHS SCAM: State continues to delay opening Adarsh report

TOWER OF DECEIT
Oppn Wants Document Made Public At Earliest

Mumbai: A day after the state appointed Adarsh judicial commission presented its 700-page report on the controversy to the chief secretary, the government on Friday continued to delay opening the document. This despite the scam having rocked the defence, political and bureaucratic establishments, and the nation being shocked by the ease with which flats in a residential complex meant for serving and retired defence personnel and their kin were sold to bureaucrats, politicians and their kin.

It has taken the panel over two years to complete its report on the controversy that led to a chief minister resigning and 14 high-profile figures, including serving and retired bureaucrats and military officers, being chargesheeted by the CBI.Of the14, nine were arrested. They included two retired major generals, a retired brigadier, four serving and retired bureaucrats, a retired defence estates officer and a former MLC. The MLC, Kanhaiyalal Gidwani, who was also arrested for allegedly bribing to get information about the probe, diedin November.

Despite all this urgency, chief minister Prithviraj Chavan – who stepped into the shoes of Ashok Chavan, a casualty of the scam – has yet to open the report of the high-level probe he himself ordered. The CM said on Friday: “We have received the report. We will open it in a day or two in the presence of the chief secretary and senior bureaucrats of the general administration and law and judiciary departments.” Prithviraj Chavan said he would seek legal opinion on whether the report should be put up on the internet. The setting up of the commission was announced in both state houses in December 2010. “Instead of waiting till the monsoon session, we feel that we should put it up on the website. All will depend on legal opinion,” he said.

Leader of the opposition Eknath Khadse said that since the report was itself submitted solate, it should be made public as early as possible in the larger public interest. Simultaneously, it should be displayed on the net, he said. “We feel that the CM should not wait till the monsoon session to make the entire report available to the aam aadmi,” Khadse said.

In the wake of a series of reports in TOI beginning on October 25, 2010, the CM setup the commission headed by Justice JA Patilon January 8,2011 and the CBI filed a criminal case on January 29,2011.

The panel was given 13 terms of reference, including ascertaining ownership of land, deciding whether there was a reservation for defence personnel or Kargil heroes and whether any public servant had given clearances to the society as a quid pro quo.

In an interim report last year, the commission had already submitted that the land belonged to the state. Sources said the final report has focused moréon the quid pro quo issue and directly blames bureaucrats and politicians for securing flats in the names of sons, daughter and other relatives.

A moot question concerns the observations made with regard to former CMs Ashok Chavan, Vilasrao Deshmukh and Sushilkumar Shinde. Unconfirmed reports say that no major strictures have been passed against them, though Ashok Chavan (who was revenue minister at one time) has been accused of allotting flats to relatives, while Deshmukh and Shinde have been blamed for procedural lapses.

If there is no major blot against Ashok Chavan, it could pave the way for his political rehabilitation.

Adarsh panel ‘spares’ ex-CMs, blames babus

Mumbai: Finding that rules were bent for allotting land and granting various concessions to Adarsh housing society in Colaba, the two-member judicial commission appointed to probe the scam has reportedly spared three former chief ministers.

Sources said the commission’s recently submitted report did not fix direct responsibility on or pass adverse remarks against Ashok Chavan, Sushilkumar Shinde and the late Vilasrao Deshmukh. It instead pinned the responsibility on seven to eight retired or acting senior state officials for the lapses and for misleading the CMs.

Sources said the commission referred extensively to the CBI chargesheet, among other documents, while fixing responsibility on officials.

While the CBI chargesheet named four retired and acting IAS officers—Subhash Lala, Ramanand Tiwari, Jairaj Phatak and Pradeep Vyas—and a retired government officer, PV Deshmukh, as the accused in the case, sources said the commission fixed responsibility on other officers too.

Reiterating that the land allotted to Adarsh belonged to the state and rejecting defence establishment’s claim of ownership of the plot, the commission reportedly observed that rules were bent for the allotment of the land to the society.

The commission observed that no advertisement or public notification was brought out to invite applications for the allotment of the revenue land in violation of norms. The plot was allotted to Adarsh in 2003.

The commission also questioned an April 10, 2002, notification issued by the urban development department for reduction of width of the Captain Prakash Pethe Marg from 60.97 m to 18.92 m and modification of reservations on the deleted portions. It observed that the decision was “one-sided.’’

It reportedly found that rules were violated and incorrect Maharashtra Regional and Town Planning provisions were applied while allowing the society to use the FSI of a neighbouring 2,670 sq m BEST plot as a special case on payment of charges.

The commission found some truth in the allegation that many society flats were benami, reportedly pointing out 20 such instances. It raised questions on affidavits filed by at least 35 of the 103 society members and did not rule out bogus affidavits.

Naming Congress leader Kanhaiyalal Gidwani as having played a major role in the land allotment and extension of concessions, the commission questioned the source of finance for some members.

It pointed out that San Finance owned by businessman Ajay Sancheti provided loans to 10 members and builder Jayant Shah, known to be close to Ashok Chavan, gave loans for five flats. It pointed a finger of suspicion on the ownership of two flats, of Raghunath Bhonsale and Rupali Raorane. Allegations linking these flats to two senior ministers were raised in the past.

Sources also said the state government failed to insist on submission of the report in time for it to be placed before the recently concluded budget session. The government has indicated it would submit an action taken report during the monsoon session.

Garden illegally scrapped, its FSI given to VIP societies: Activists

Mumbai: New violations have surfaced at two Worli housing societies that are home to top politicians, with activists saying a public garden was de-reserved to increase floors without requisite permissions from the Maharashtra Coastal Zone Management Authority (MCZMA) and the civic body.

The Sukhada and Shubhada societies are already in the spotlight for notices sent by the Brihanmumbai Municipal Corporation (BMC) to some residents, from deputy CM Ajit Pawar to BJP leader Gopinath Munde, for illegal alterations and conversion of shops into offices and gyms.

In the garden case, the BMC had repeatedly requested the urban development department not to go for deletion of the open space reservation. TOI has a copy of the resolution passed by the BMC improvements committee on November 5, 2001, where it stated that the modification would serve no public purpose and would be beneficial only to the developers of adjoining plots.

Despite the objections, the state government agreed to dereserve the garden plot and transfer the floor space index (FSI) to a residential zone.

In a reply to an RTI application filed by activist Amit Maru, it was learnt that the deputy chief engineer of development plan wrote to the secretary of urban development department in 2001, that the land belonged to the estate department of the BMC and the public garden reservation could not be deleted. If deleted, the land could be merged with the adjoining plot only with BMC sanction.

“It was also noted that the land falls within 500 metres of the high tide line and thus is affected with the CRZ notification of 1991,” Maru said. “This is a clear case of corruption and land-grab by politicians. An inquiry should be initiated by the municipal commissioner and the officer hand in glove with politicians should be prosecuted under the Prevention of Corruption Act.”

Lawyer and former IPS officer Y P Singh had filed a legal notice on July 19 last year to the MCZMA chairperson and additional chief secretary, urban development department, stating that there was an illegal FSI grant to the societies.

“Under the CRZ notification there can’t be any change in user or deletion of garden reservation in the CRZ,” he said. “The FSI of a plot can’t be more than what it was on February 19, 1991, the date of CRZ notification. They de-reserved the garden plot and moved its FSI to the neighbouring plot. This was done without permission from the MCZMA and the MoEF.”

ADARSH CHS SCAM: Ex-CM moves HC to quash FIR in Adarsh case

Mumbai: Former Maharashtra chief minister Ashok Chavan has moved the Bombay high court urging it to quash the FIR against him by the CBI in the Adarsh scam case. Hearing Chavan’s petition, a division bench of Justice Abhay Oka and Justice Ashokh Bhangale asked his lawyers whether the petition would survive since the CBI had already filed a chargesheet in the case.

Chavan and 12 others were charged in the Adarsh case by the CBI. In his petition, Chavan has questioned the jurisdiction of the CBI to probe the case since no consent had been taken from the state government. Alleging that the case was a political conspiracy to target him, the petition has urged the court to restrain the CBI from initiating any action against him.

Chavan was accused of allegedly taking decisions that benefitted Adarsh during his term as revenue minister and then as CM. The allegation against him is that after meeting promoters of Adarsh, a decision was taken to include civilian members in society initially meant for defence personnel. This decision helped his relatives get flats in Adarsh. As CM in July 2009, he allegedly gave society the concession of 15% recreation ground, not allowed earlier by the state. The HC has posted the next hearing for March 15.
