Loan Scam : SBI sends Deputy MD on leave, sets up internal probe

State Bank of India (SBI) has asked its Deputy Managing Director and Group Executive (mid-corporate) Shyamal Acharya, who is under investigation in a bribery case, to proceed on leave and set up an internal committee to probe the matter.

Acharya has been named by the CBI along with former SBI assistant general manager KK Kumarah and Piyoosh Goyal, chairman of Worlds Window Group in a graft case involving a Rs 400 crore loan.

"We have been advised by CBI that Acharya is being investigated. SBI is co-operating with CBI. SBI has constituted an internal committee comprising two senior managing directors to investigate internally," SBI said on Monday.

A Krishnakumar and Hemant Contractor are the two senior most MDs at the bank.

CBI's Economic Offences Wing in Mumbai has already registered a case against Acharya — one of the 12 Deputy MDs, Kumarah, Goyal and "other unknown officials of SBI and private persons".

In SBI, corporate loans above Rs 500 crore need the approval of the MD and loans are vetted by four committees depending on the size. While loans above Rs 75 crore will have to be cleared by one of the committees in the head office, the executive committee and the full board committee take decisions on mega loans and sensitive projects.


In this case, the mid-corporate committee, allegedly influenced by Acharya, might have cleared the Rs 75 crore loan, sources said.

Kumarah has been arrested and remanded to police custody till November 27. Acharya is yet to be arrested.

In a detailed statement, CBI said, that Goyal had applied for Rs 400 crore corporate loan amongst others to SBI. Kumarah, an advisor to the company approached Acharya for getting it sanctioned. "The Deputy MD allegedly influenced his office to process the loan application of the company and got the loan of Rs 75 crore sanctioned," CBI said.

After the loan was sanctioned, the company allegedly gave Rs 25 lakh to Kumarah as reward and also gave him Rs 15 lakh for passing it on to Acharya. Kumarah allegedly purchased one Rolex wrist watch and one Omega wrist watch worth Rs 7.75 lakh and presented them to Acharya at his office.

"After delivery of the wrist watches, the advisor was apprehended by CBI and the two wrist watches were also recovered from the office cabin of the Deputy MD," CBI said.

CBI said it recovered cash of Rs 7 lakh, locker keys and other incriminating documents from the residence of Kumarah. Gold and jewellery worth Rs 67 lakh, locker keys, documents pertaining to investments in FD and other incriminating documents were recovered from the residence of Acharya. CBI also recovered cash of Rs15 lakh, jewellery and other documents from the residence of Goyal.

World's Window Impex India denied having paid a bribe to secure any facility. "We have not paid any bribe to anybody to secure any facility," Worlds Window Impex India said in a statement. (With PTI)

CBI finds haul of gold, 40 scotch bottles in SBI DMD’s house

Gold and jewellery worth Rs 67 lakh, forty bottles of scotch, and documents showing benami purchase of 10 kilogram of gold were found by the Central Bureau of Investigation at the Napean Sea road residence of deputy managing director of State Bank of India Shyamal Acharya, who was booked on Saturday on charges of bribery.

Acharya will be asked to explain the source of income for these purchases. Even the scotch will be accounted for while determining his wealth, said sources. “In case he is unable to account for these items, we will register a fresh case of corruption against him for amassing wealth more than his known sources of income,” CBI sources said. They remarked that Acharya had a large quantity of gold coins in his house. The agency will conduct a search of Acharya’s personal bank locker on Tuesday.

CBI has also sealed two offices of a jeweler Amrut Jain - one at Zaveri Bazar and another in central Mumbai - through whom Acharya is suspected to have invested in 10 kilos of gold. The agency had summoned Jain for interrogation, but he has evaded them so far, sources said.

SBI has instituted an internal probe into the matter and has asked Acharya to proceed on leave, pending investigation.


Acharya, a DMD at SBI and Head of Mid-Corporate division, was booked along with Piyoosh Goyal, managing director of Delhi-based Worlds Window Impex India Limited on bribery charges after the CBI conducted a raid on Acharya’s residence and seized an imported pair of watches worth Rs 8 lakh.

It was Goyal who had allegedly gifted Acharya the watchestogethiscreditlimitfromthebankincreased.KK Kumra, a former SBI Assistant General Manager, who was working as a liason agent for Worlds Window and who haddeliveredthewatches,hasbeenarrestedandisnowin CBI custody.

Worlds Window had been allegedly planning to pay Rs. 15 lakh as bribe to Acharya; while Rs 8 lakh was accounted for by the watches, the remaining Rs 7 lakh was found by the CBI at K K Kumra’s residence on Saturday.

Worlds Window is an industrial group which imports ferrous and non-ferrous metal scrap, manufactures aluminium composite panels (ACP) and runs India’s biggest private inland container depots. It has a credit limit of Rs 250 crore with a consortium of banks including SBI. The bribehadbeenpaidtoraisethecaptoRs.400croretofund the company’s ongoing expansion plans. SBI’s contribution to the increased credit was to be Rs 75 crore.

CBI has alleged that Shyamal Acharya, who was originally not in charge of sanctioning the loan, got the case moved under his charge. In this peculiar bribery case, the complaint was not lodged by Worlds Window, but was registered on the basis of surveillance by CBI on Acharya over the past few weeks.

SBI sends Kingfisher legal notice to recover its loans

Banks unsure of recovery despite selling USL shares
State Bank of India (SBI) has sent the beleaguered Kingfisher Airlines (KFA) a legal notice relating to the recovery of loans, bankers said on Tuesday. KFA can either suggest an out-of-court settlement or take legal recourse, in which case bankers will move the debt recovery tribunal (DRT), a banker explained.

Although the lenders have sold shares of United Spirits (USL) and Mangalore Chemicals and Fertilisers, banks are still not confident of recovering their entire loans from KFA. “It looks like we will have to invoke the corporate guarantees given by United Breweries Holdings (UBH) to recover the loans,” a banker with direct knowledge of the development said.

Last week, a consortium of 17 lenders, led by State Bank of India (SBI) sold off 26.5 lakh shares of USL. Banks had also sold pledged shares of Mangalore Chemicals and Fertilisers, realising around R100 crore.

KFA owes over R7,000 crore to lenders as per news reports. Consortium leader SBI has maximum exposure to Kingfisher at R1,800 crore.

Other lenders to the grounded airline are Punjab National Bank and IDBI Bank (R800 crore each), BoI (R650 crore), Bank of Baroda (R550 crore), United Bank of India (R430 crore), Central Bank of India (R410 crore), UCO Bank (R320 crore), Corporation Bank (R310 crore), State Bank of Mysore (R150 crore), Indian Overseas Bank (R140 crore), Federal Bank (R90 crore), Punjab and Sind Bank (R60 crore) and Axis Bank (R50 crore).

In his appeal to the Bombay High court on April 1, the debt-laden airline’s promoter Vijay Mallya had sought to restrain banks from selling the USL shares pledged with lenders for three weeks. However, the court ruled in favour of the banks the very next day, allowing them to go ahead with share sales to recover loans.

The UB Group, also promoted by Mallya, had reached an agreement with UK-based global liquor giant Diageo for sale of a majority 53.4% stake in USL for about $2 billion. The Diageo deal is currently in the process of completion and has been cleared by regulators like Competition Commission of India and Securities and Exchange Board of India. The deal includes an open offer for purchase of 26% stake from non-promoters.
