Monopoly Contracts Model Triggers Alarm Among Govt Officials
New Delhi: UPA-II’s flagship direct cash transfer scheme has run into rough weather following warnings of a potential scam in the making, and evoking concerns of serious delays.

Government functionaries have raised the red flag about how cash would be finally disbursed to beneficiaries and whether the National Population Register (NPR) would come into play in some states instead of the Unique Identification (UID) number to identify the end-users.

Senior government functionaries have warned that the Centre could be staring at a potential scam if the scheme is hinged to the finance ministry’s department of financial services’ move to hand over monopoly contracts for distribution of money while taking a cue from the ‘one cluster, one bank correspondent company’ model.

The proposal is to divide the country into 20 clusters and have one firm each that handing over the cash from banks to beneficiaries. But advisors have been cautioned that this could lead to monopoly control over UPA’s `gamechanger’ scheme by certain companies, triggering scams. They have warned that the initial rollout of this model, where companies bid for much less than 2% fee for delivery of funds to beneficiaries, has already lent the whiff of a potential scam. For indiculously low in some cases.

The rural development ministry and the UID Authority of India (UIDAI) have advocated against this approach but different government functionaries have made conflicting statements about a resolution to the row.

D K Mittal, secretary in the department of financial services (ministry of finance), told TOI, “We will monitor the rollout and if any problems are noted they will be addressed immediately.”

He added that the department was geared to ensure that the banking correspondent model takes off in the 51 districts where the scheme is to be launched as a pilot. In these districts where the company is yet to take over the cluster, the banks have been asked to move in first, and the firm that gets the cluster through bidding would take over later, he explained.

Another concern that is plaguing the initiative is whether to trust NPR as a platform for timely electronic registration of the population in some states instead of UID.

Government functionaries have warned that progress of NPR’s work is rather tardy in some states like UP, Bihar and Odisha. The volatile issue, which earlier too had attracted high-voltage sparks between UIDAI chief Nandan Nilekani and then home minister Chidambaram, has now been left to the PMO to resolve.

Medical Scam: With no laws, pharma firms have a field day

IN THE absence of any penal provisions that may be applied in cases where pharmaceutical majors use unethical practices to woo doctors to promote drugs, pharma companies brazenly offer incentives to doctors, flouting the Department of Pharmaceuticals’ ‘voluntary code’.

As a result, while a December 2009 code of medical ethics developed by the Medical Council of India (MCI) includes legal provisions to punish doctors who accept gifts from pharmaceutical companies in return for aggressively prescribing certain drugs, there is nothing to stop drug manufacturers’ unethical practices.

Santhosh M R of the Centre for Trade and Development (CENTAD), an organisation that conducted a study on pharmaceutical companies on behalf of the Competition Commission of India (CCI), says, “In the absence of any legal provision, no company can be prosecuted (for such activities). Thus, they are fearless.” On Thursday, DNA reported that the country’s top pharma firms routinely offer considerations ranging from gifts including electronics and gold coins to foreign trips to doctors who achieve pre-fixed targets for prescriptions of certain drugs.

The 58th report of the Parliamentary Standing Committee on Health and Family Welfare dated May 8, 2012 says there appears to be little logic in keeping the code for companies a voluntary one. “The Committee has been given to understand that the voluntary code has generally not been successful in curbing unethical practices and off-label promotion of drugs,” the report says, adding that the Secretary (Pharmaceuticals) was unable to offer any valid reason for not making the uniform code a statutory provision.

A statement to DNA from the World Health Organization also opined that implementation of the code must be reviewed. “If it is found that it has not been voluntarily and effectively implemented by pharmaceutical associations/ companies, the government should consider making it a statutory or binding regulation,” the WHO said.

Also worrying is that companies keep the working and service conditions of medical representatives, the foot soldiers who meet doctors and promote drugs, highly suspect.

While the Sales Promotion Employee (Conditions and Services) Act, 1976 empowers medical representatives and regulates their service conditions, the Federation of Medical & Sales Representatives’ Association of India (FMRAI) which represents more than 1.5 lakh medical representatives, says almost no pharma firm issues legally amended appointment letters as stipulated by the Act. “If they give appointments under Form A, they would be bound by the Act and all the labour laws would prevail. In such a scenario, the employees will have a stronger say and can refuse to participate in unethical practices,” said JS Majumdar, former general secretary of the association.

“This in turn would mean that they would be forced to undertake unethical practices.Even if they are caught, the blame would come on representatives and doctors,” Santhosh added.

Several appointment letters of sales promotion employees accessed by DNA show that they are recruited as territory business managers, product executive and product specialists, etc. In fact, when the issue was brought to the notice of the central government in August 2010, KM Gupta, economic advisor to the Centre’s labour department, sent a letter to labour secretaries of all states advising imprisonment as a penalty for employers who violate the provisions of the Act.

The FMRAI also gave a memorandum to the Labour Minister, Government of Mahrashtra, in February 2012 regarding the violation of the law by pharma companies.

Medical Scam: ‘Pharma firms-doctors nexus puts patients at risk’

Responding to reports in DNA about unethical practices adopted by pharmaceutical companies to incentivise doctors to promote certain drugs, medical practitioners agreed that the long-term repercussions of such brazen wooing of doctors with gifts and foreign trips could be serious.

“Due to incentives, some doctors start over-prescribing to achieve the targets and the stockist goes out of his way to sell the products. This ultimately affects the customers in terms of high costs and overdosing,” said Dr Suchitra Ramkumar, a medical practitioner and trustee of Citizen Consumer and Civic Action Group (CAG).
Apart from the fact that doctors’ overzealousness in prescribing drugs could see rising healthcare costs, there is also the issue of medical side-effects. “Over-prescribing may lead to patients going through various physical problems due to side–effects,”said Dr Satyajit Kr Singh MS, Fellowship of the Royal College of Surgeons(FRCS) and Ex. Lecturer of the Diplomate Institute of Urology (London), who has worked in various countries across the world.

Admitting that the practice of accepting gifts does exist among doctors across the country, Dr BS Garg, president of the Maharashtra Voluntary Heath Association of India (VHAI) working in Wardha, said, “In districts, the doctors and chemists are even more closely interlinked and so by offering incentives to them, the companies are trying to capture the market. All the money which a pharma company invests in buying gifts or offering incentives is ultimately recovered from the customer.”

The World Health Organistaion in a statement to DNA said the uniqueness of the Indian healthcare system is its relatively well-established private healthcare system. “This means that all decisions with regard to patient care are made by individual or a group of doctors, making doctors very important as a client to pharmaceutical companies. Understanding the MCI Code is only part of the compliance programme for pharmaceutical companies. From a more practical perspective, companies need be aware that anti-corruption compliance is not an additional value to risk management, but an indispensable part of the whole corporate business,” the statement said.

Dean of the Lokmanya Tilak Municipal General Hospital, Sion, one of Mumbai’s largest civic government-run hospitals, Dr SuleimanMerchant, said there would be no takers if there were no givers. “So if there are strict laws in the country for the gift takers, there should be equally strict laws for Pharma companies too,” he said, mirrorring the opinion of several experts. “Not all are involved in this unethical practice,” he added.

According to the President of the Indian Medical Association (Maharashtra) DrAnil Pachnekar also agreed that doctors often face the repercussions while companies offering these gifts get away. “Pharma companies target doctors with more prescriptive power, be it in cities or smaller towns. The ones who are caught are dealt out punishment, but the pharma companies are left out. The crackdown is only on doctors and companies get away because they have a strong lobby.”

Amanath Cooperative Bank Scam: UPA minister faces `300 cr graft case

Karnataka state minorities commission on Friday lodged a complaint against Union minister for minorities K Rahman Khan of being involved in the misappropriation of public money in Amanath Cooperative Bank when he was its president.

According to its chairman Anwar Manippady, the minorities’ commission received a complaint on November 6 from S Ahmed Ibadullah, advocate of SAI Associates, on the alleged misuse of funds amounting to Rs300 crore by former presidents of the bank during their regime.

Though the misappropriation was clearly established, no action was taken so far by the department of cooperative societies, police and the RBI.

“Over Rs300 crore is reportedly misused by K Rahman Khan when he was at the helm of affairs,” Manippady alleged.

The complaint was lodged against Khan and others by Manippady before the Upalokayukta, S B Majage. The Lokayukta post is vacant in the state. However, Rahman Khan dismissed as “politically motivated” the complaint lodged against him with Karnataka Lokayukta even as the BJP demanded his resignation.

Khan said if he had misappropriated Rs 300 crore during his tenure, there would have been “zero balance in the bank”.

Mining Scam : Illegal mining-losses between Rs 20k to 30k crore

Illegal mining in Karnataka is a matter that is being investigated by many agencies and the losses that each of these agencies have estimated is shocking in number. The latest is a report by the Comptroller and Auditor General (CAG) of India which has estimated the loss caused due to illegal mining at Rs 3414 crore and ironically the state government has been able to recover just Rs 7.22 crore. However according to Anita Pattanayak, Principal Accountant General (Audit) of the CAG, Karnataka, “ if one goes by the current value of ore then the loss can be at an estimated Rs 25000 crore. The current market value of iron ore is at Rs 4800 per metric tonne.

The report of the CAG between the years 2006 and 2011 was put out before the Karnataka legislative assembly. The losses which are mentioned in the report are as per the market value of iron ore in those respective years. However if one takes into account the value of ore today, then the loss is at Rs 25000 crore.

The CAG in its report has made the estimation based on the amount of Rs 750 per metric tonne of iron ore. Today the market value is seven times higher and hence the figure of Rs 25000 crore could be arrived at. However the government of Karnataka which had claimed that it had acted against illegal mining managed to recover just Rs 7.22 crore and that is once again as per the estimated value of Rs 750 per mt tonne.

Former Lokayukta of Karnataka, Justice Santhosh Hegde who had put out the first report on illegal mining had estimated the loss to be at around Rs 16085 crore. This was a figure arrived at based on the market value of the year in question and the report was based on the mining losses between the years 2000 and 2011.

The report by the CAG would only go on to show the sudden rise in illegal mining between the years 2006 and 2011. It has been considered to be the peak time for mining and the demand for ore has shot up during the China Olympics. This has led to a lot of illegal mining and hence the losses too were at a record high.

In the report by the CAG it states that the department of mines and geology had accepted audit observations of Rs 1212.12 crore and had recovered just Rs 7.22 crore. The report also came down on the Karnataka government for not having drawn up any plan to monitor the Karnataka Mineral policy.

Justice Hegde, says that the valuation done by the CAG is very much in tandem with the report put out by him when he was the Lokayukta of Karnataka. The CAG agrees with the valuation done by us. We had done the valuation for the years 2000 to 2011 and we estimated the losses as per the market value of iron ore of each year. As per our estimates it was at Rs 16085 crore. The CAG has estimated as per the value of Rs 750 per metric tonne and hence finds the loss at Rs 3414 crore. However the loss is much higher if taken at the current market value of Rs 4800 crore per metric tonne.

The Central Bureau of Investigation is also looking into the case and puts the loss at Rs 15000 crore. However in specific to the Obulapuram Mining Company run by Janardhan Reddy it says that the loss caused by this company alone is Rs 5100 crore.

The Central Empowerment Committee which was appointed by the Supreme Court to look into illegal mining in Karnataka is yet to put out a complete report on the issue. But it had told the Supreme Court that it would estimate the loss at around Rs 30000 crore as per the current market value of iron ore.

The Goa scenario: 
The scene is equally bad in Goa too. The matter which was first probed by the Justice MB Shah Commission says that the total loss caused to the exchequer of the state due to illegal mining is Rs 35000 crore as per the current market value of iron ore. This is around Rs 10000 crore more than Karnataka. The CEC too in its report which was submitted recently had estimated the loss at around the same amount. The CEC had submitted an interim report and would put up a final one in the next couple of months which would give a better picture of the loss due to illegal mining.

Modus operandi:
The modus operandi in both the states which have been badly affected due to this issue remains the same. In both the cases it has been found that illegal mining took place with the blessings of the government. In Karnataka it was the BJP, JD(S) and the Congress which facilitated illegal mining whereas in Goa the entire blame has fallen on the Digambar Kamath led Congress government.

Thanks to the involvement of politicians in illegal mining in both states they found it easy to flout the norms and mine illegally. In both the states the bulk of the mining was found in restricted areas such as forests which shook up the ecology of the region badly. Further it was also found that ore more than the permissible level was ferried out of the region. This had led to the loss to the state’s exchequer and in both states it was found that the recovery was a negligible amount.

Scam In MHADA : Mhada yet to get 3,300 houses from 33 builders

MUMBAI: Thirty-three builders have been served notice by the Maharashtra Housing and Area Development Authority (Mhada) for not surrendering 3,300 houses to the housing board as per rules. They have two months in which to comply.

Mhada officials said the builders had defaulted in handing over 10 lakh square feet to the board after redeveloping old properties. The 10 lakh square feet translates to around 3,300 houses of 300 square feet each.

Mohan Thombre, chief officer, Mhada (Mumbai buildings repairs and reconstruction board), said the housing board was serious about getting the houses.

“We have given them grace of two months to give us these houses. We have also given them a choice. If they are unable to give us flats in their buildings, they can make arrangements to give us flats of the same size in other buildings in the same area,” Thombre said.

Mhada has also decided to fine these builders Rs40 crore. A few months ago, Mhada had even filed police complaints against these builders.

Thombre said the flats in Matunga, Dadar, Prabhadevi, Mumbai Central, Byculla, Mazgaon and Mahim, would be sold at affordable rates through the usual lottery system.

Ramakant Jadhav, CEO, Shivalik Ventures Private Limited, a defaulter in two such cases, was abusive. “Why should I tell you what I am going to do? Who are you,” Jadhav told HT.

Shabbir Patel, chairman, Oscar Builders Private Limited, said that he was ready to hand over the flats but was besieged by a legal matter.

Scam In Medical Field : Pharma firms ply doctors with gifts

So that docs prescribe their costly medicines... it is a win-win for both parties at the expense of patients
Even as the prime minister Manmohan Singh-led National Development Council meets on Thursday to discuss a law to curb unethical practices adopted by pharmaceutical companies to persuade doctors to promote their products, a four-month investigation by DNA has shown that the ‘pay-for-prescription’ practice flourishes. While doctors admit that there is a grave danger of drugs being overused when pharmaceutical companies woo doctors and stockists with various sops for promoting their drugs, even the  parliamentary standing committee on health and family welfare in a report dated May 8, 2012 says there is no let-up in this “evil practice”. It says, “... pharma companies continue to sponsor foreign trips of many doctors and shower them with high value gifts like air conditioners, cars, music systems, gold chains etc... to obliging prescribers who then prescribe costlier drugs as quid pro quo. Ultimately all these expenses get added up to the cost of drugs.”

What’s more, the pharma firm-doctor nexus is not limited to innocuous over-the-counter drugs, a DNA investigation has found.

Take the example of US Vitamin (USV) Ltd, a major player in the oral antibiotics market. In August 2011, its product manager wrote to company representatives appreciating their efforts in making

its product, Drego-D, the Number 1 prescribed brand in the preceding two months. The letter went on to say they should also push another drug, Drego, similarly, given the huge opportunity it presents. All doctors except paediatricians have the potential to prescribe Drego, the letter urged. Drego and Drego-D are both Schedule H drugs, to be sold only on the prescription of a registered medical practitioner.

The letter goes on to detail the promotional activities for the Drego group of drugs, including “on demand campaign” every month specifically for general practitioners, ENT specialists, orthopaedics, gynaecologists and more.

The “engagement” and “development activity” for these doctors included investment of Rs65,000/ year or Rs80,000 per year on one or two selected doctors for a single drug, the letter revealed. “...with such a line of promotion we are sure that you all will very easily achieve a minimum per member per month (PMPM) of 250 strips of Drego & 350 strips of Drego-D,” the letter said, going on

to insist that representatives should, during their field work, ensure that doctors give Drego prescriptions “on priority”.

The letter posted a target a business worth Rs14 crore for a single drug in a single year.

The company’s brochure also says doctors stood to win a smartphone or LCD television once they enter the “MPower Club” for a certain number of prescriptions of Zylera, a drug for nasal problems or asthma-like symptoms, also a Schedule H drug.

Franco India, expected to have a turnover of Rs2.1 billion this year, offers a variety of gifts to doctors, including a hamper of basmati rice, handmade orange soap, an all-in-one mobile phone charger and other stationery items.

Svizera Healthcare, a division of Maneesh Pharmaceuticals Limited, issued a brochure called Club Inspira 2010-2011, which invites doctors to become members by prescribing products worth

Rs50,000 between May and August 2010. The prescriptions would have to be for Si-Fixim, Si-Fixim XL, Si-Fixim CV, FlanZen, FlanZen D/DP and others.

These are all highly sensitive drugs. Si-Fixim is generally used for the treatment of infections caused by susceptible bacteria. Doctors prescribe the medicine to patients suffering from upper

respiratory tract infections, such as pharyngitis, sinusitis, tonsillitis and lower respiratory tract infections like acute bronchitis and acute exacerbation of chronic bronchitis etc. FlanZen is

prescribed for reducing inflammation and edema occurring due to rheumatic disorders, surgeries, breast engorgements, pregnancy-related thrombophlebitis as well as fibrocystic breast diseases.

It causes hypersensitivity reactions including rashes, abdominal discomfort and nausea if not taken properly.
Those entering the ‘club’ would be eligible for a gift, with their options ranging from a microwave oven, digital camera, a gold coin, etc.

While doctors get incentives for prescriptive drugs, incentives are offered to stockists for non-prescriptive drugs too. Though some may debate that there is nothing wrong in offering incentives to

the stockists, but others believe it does make the stockist unethically push for product in order to win the gifts.

A Gelusil festival extravaganza was announced by Pfizer to strengthen the product’s position as the Number 1 antacid in its category. Distributors were offered slab-wise gifts for achieving targets

and also a chance to participate in a lucky draw. A similar offer had been launched last year for Becosules, the vitamin supplement. On offer was a chance to win diamond pendants, gold chains, travel bags, LCD televisions, home theatres, and wrist-watches.

While most pharma companies DNA approached refused to respond to queries on ethical practices while promoting drugs, Pfizer spokesperson Shyam Kumar said the company takes

compliance with norms very seriously. “In fact, over the past several years, Pfizer has taken very significant steps to strengthen our internal controls and pioneer new procedures in the area of

compliance. Corporate integrity is an absolute priority for Pfizer, and we will continue to take appropriate actions to strengthen public trust in our company.”

Dr Kailash Sharma, member, board of governors, Medical Council of India, and director, academics, Tata Memorial hospital, said, ”MCI has already given strict guidelines but the practice of

accepting gifts is so prevalent, it becomes difficult to monitor. Doctors must restrain themselves from accepting gifts or foreign trips from pharma companies. There is a need to bring in penal

provisions for pharma companies, which offer gifts to doctors. There is also a need to audit the accounts of pharma companies to know how much they are spending on publicity.”

भारतीय थल सेना दिसंबर में पांच विदेशी कंपनियों की असाल्ट राइफलों का परीक्षण करेगी. नई राइफलों की खरीद पर 2,500 करोड़ रु. खर्च किए जाने हैं. यह ठेका काफी अहम है क्योंकि इससे तय होना है कि दुनिया की दूसरी सबसे बड़ी सेना के करीब 12 लाख जवान अगले दो दशकों तक कौन-सा हथियार लेकर चलेंगे.
सेना ने जब नवंबर, 2011 में इसके लिए टेंडर की घोषणा की थी तो इससे अंतरराष्ट्रीय हथियार कारोबारी एकदम से हरकत में आ गए थे. कुल 65,678 मल्टी कैलिबर असाल्ट राइफलों (एमसीएआर) के शुरुआती ऑर्डर के अलावा टेंडर में ऐसी 1,00,000 लाख राइफलों की इंडियन ऑर्डनेंस फैक्ट्रीज में उत्पादन के लिए लाइसेंस की मांग भी की गई है जिससे यह सौदा कुल 1 अरब डॉलर (5,500 करोड़ रु.) का हो जाता है. यह आधिकारिक रूप से हाल के समय में छोटे हथियारों की खरीद का दुनिया का सबसे बड़ा सौदा है.

रूस, अमेरिका, यूरोप और इज्राएल के हथियार निर्माता सक्रिय हो गए हैं. दिल्ली में हथियारों के एजेंट इस सौदे से मिलने वाली दलाली का हिसाब लगाने लगे हैं जो 100 से 250 करोड़ रु. के बीच तक हो सकती है. दूसरे घोटालों की तुलना में यह कहीं नहीं ठहरता, फिर भी इसे एक बड़ी रकम तो माना ही जा सकता है.

इस खेल का दूसरा खिलाड़ी 64 वर्षीय भूपिंदर है जो गुपचुप काम करता है और अभी तक जांच रडार पर नहीं आया है. सेना के हलकों में ‘टस्की’ के रूप में मशहूर भूपिंदर दक्षिणी दिल्ली के वसंत विहार में रहता है. कई साल से भूपिंदर गृह मंत्रालय में छोटा खिलाड़ी बना हुआ है. वह मुख्यतः छोटे साजो-सामान के ठेकों के माध्यम से पुलिस और अर्धसैनिक बलों की जरूरतों को पूरा करने में लगा है. गृह मंत्रालय और रक्षा मंत्रालय, दोनों ने रक्षा सौदों में एजेंटों की सेवा लेने पर रोक लगा रखी है. सैद्धांतिक रूप से तो सारा मोल-तोल सीधे साजो-सामान बनाने वाले मूल मैन्युफैक्चरर से किया जाता है. लेकिन यह भी सच है कि हमेशा इन निर्देशों पर अमल नहीं किया जाता है.

दिल्ली के एक हथियार एजेंट ने बताया, “अभिषेक तड़क-भड़क वाला, हंगामेदार और सामने आकर काम करने वाला है. यही उसकी बर्बादी का कारण है. उसकी पार्टियों में सिंगल माल्ट पानी की तरह बहती है. यूरोपीय एस्कॉट्र्स उसके मेहमानों की खिदमत में लगी रहती है.” एजेंट के मुताबिक, टस्की सयाना कारोबारी है, “उसके वसंत विहार स्थित मकान पर गुपचुप से पार्टियां आयोजित होती हैं.”

देश में छोटे हथियारों का आयात एकदम मामूली है. इस पर कोलकाता स्थित सरकारी इंडियन ऑर्डनेंस फैक्ट्रीज का एकाधिकार है. 26 नवंबर, 2008 को मुंबई में हुआ आतंकी हमला और वामपंथी उग्रवाद के साथ लड़ाई ग्लोबल हथियार उत्पादकों के लिए अप्रत्याशित फायदा लेकर आई है. गृह मंत्रालय का बजट काफी बढ़ गया है.

गृह मंत्रालय ने अगले पांच साल में राज्य पुलिस और अर्धसैनिक बलों के हथियारों और संचार व्यवस्था को उन्नत करने के लिए 38,000 करोड़ रु. की आधुनिकीकरण की योजना बनाई है. इसमें से 13,000 करोड़ रु. सात अर्धसैनिक बलों और बाकी रकम राज्यों की पुलिस पर खर्च की जाएगी. बुल्गारिया की एके-47, इज्राएल की टवोर्स और जर्मनी की एमपी-5 सब-मशीन गनों का बड़े पैमाने पर आयात शुरू हो गया है.

भूपिंदर ने 2009 के आसपास इटली की हथियार निर्माता कंपनी बरेटा के भारत में प्रतिनिधित्व का काम संभाला. उन्होंने इंडिया टुडे को बताया, “हम आधिकारिक रूप से तीन साल से बरेटा के साथ काम कर रहे हैं. जब हम गृह और रक्षा मंत्रालयों के साथ काम करते हैं तो किसी तरह की गलत गतिविधि से कोसों दूर रहते हैं.” हालांकि,  भूपिंदर के बेटे उदय सिंह का कहना है कि उन्होंने आवेदन तो किया है, लेकिन अभी उन्हें भारत में ऑफिस खोलने के लिए रिजर्व बैंक से इजाजत नहीं मिली है.

टस्की और उदय सिंह ही ऐसे हथियार एजेंट थे जो 17 और 20 मई को हरियाणा के भोंडसी स्थित सीमा सुरक्षा बल (बीएसएफ) के केंद्र में हथियारों के परीक्षण के दौरान मौजूद थे. इस परीक्षण में मौजूद कुछ अधिकारियों ने बताया कि इस दौरान भूपिंदर बीयर और सॉफ्ट ड्रिंक के साथ बीएसएफ अधिकारियों की खुशामद में लगे थे.
14 फरवरी, 2011 को पहली बार रक्षा हलकों में उन्हें लेकर कान खड़े हुए और उन पर गौर किया गया. बरेटा ने गृह मंत्रालय के साथ 34,377 कार्बाइन के करीब 200 करोड़ रु. के सौदे पर दस्तखत किए. अब टस्की का नाम सुरेश नंदा और मोहिंदर सिंह साहनी जैसे बड़े हथियार डीलरों की कतार में शामिल हो गया है. नंदा का नाम सीबीआइ ने बराक मिसाइल सौदे में एक एजेंट के तौर पर लिया है और साहनी को भी सीबीआइ ने क्रासनोपोल गाइडेड मिसाइल युद्ध सामग्री के मामले में एजेंट बताया है.

इस ठेके को जिस तेजी से अंजाम दिया गया उसे देखकर सबको हैरत हो रही थी. ठेके से लेकर आपूर्ति तक में तीन साल से भी कम समय लगा जो भारत की सुस्त अफसरशाही के स्वभाव के एकदम उलट है. उदाहरण के लिए मुंबई हमले के बाद आए टेंडर के बावजूद अभी तक नेशनल सिक्योरिटी गॉर्ड (एनएसजी) को हेलमेट या बुलेट प्रूफ जैकेट नहीं मिल पाए हैं. बरेटा सौदे को लेकर कई विवाद (बॉक्स देखें) और विरोधियों की शिकायतें सामने आईं हैं.

विरोधियों का कहना था कि उन्हें गलत ढंग से परीक्षण से बाहर रखा गया. कुल ऑर्डर में से 2,374 कार्बाइन में खामी पाए जाने के बावजूद बीएसएफ इस सौदे पर आगे बढ़ी है. इंडिया टुडे  ने भूपिंदर और उदय से रिश्तों और टेंडर में पाई जाने वाली खामियों को लेकर बरेटा को एक विस्तृत प्रश्नावली भेजी थी.

कंपनी के प्रवक्ता ने इसके जवाब में कहा, “बरेटा भारतीय प्रशासन की ‘गोपनीयता की शर्तों से बंधी हुई है. हमें टेंडर प्रक्रिया में शीर्ष पर रहने के बाद भारत सरकार से ठेका मिला है.”

बरेटा ने आखिरकार भारत में अपनी पकड़ मजबूत कर ली थी, जिसे देखकर वर्मा आपा खो बैठे. अब उनकी नजर में एक बड़ा हथियार सौदा था, सेना के लिए असाल्ट राइफल का टेंडर जिसे पाने के लिए वर्मा बेताब था. 2007 में एनएसजी के लिए 500 एसआइजी 551 असाल्ट राइफलों की खेप देकर एसआइजी ने गृह मंत्रालय में अपना कदम रख दिया था.

5 से 7 दिसंबर तक वर्मा ने एसआइजी के मालिक माइकल ल्यूक और सीईओ रॉन कोहेन की दिल्ली में मेजबानी की. उसने हर जगह उनके भव्य स्वागत की व्यवस्था की ताकि वे यह समझ सकें कि वर्मा की दिल्ली के राजनैतिक हलकों में गहरी पकड़ है. अगले दो दिनों तक वर्मा ने उन्हें नेताओं, अफसरशाहों और सशस्त्र बलों के अधिकारियों से मिलवाया.

ल्यूक और कोहेन इस दौरान एम.एम. पल्लम राजू से भी मिले थे जो करीब आठ साल से रक्षा राज्यमंत्री हैं. उनकी दो दिवसीय यात्रा में खासकर एक जगह जाना काफी रोचक हैः मि. गांधी, सांसद (गांधी परिवार के वंशज) से उनके निवास पर मुलाकात की.’ यह साफ नहीं है कि यह रहस्यमय मि. गांधी’ कौन हैं. इंडिया टुडे ने दोनों सांसद गांधियों--राहुल और वरुण--से संपर्क किया. राहुल गांधी के प्रवक्ता ने बताया कि उस दिन राहुल दिल्ली में जरूर थे, लेकिन ऐसी कोई मुलाकात तय नहीं थी और न ही ऐसी कोई मुलाकात हुई है. वरुण ने भी इस बात से इनकार किया कि वह ल्यूक या कोहेन से मिले हैं.

ल्यूक और कोहेन ने स्पेशल फ्रंटियर फोर्स (एसएफएफ) के आइजी मेजर जनरल आर.के. राणा से भी मुलाकात की. यह गुप्त अर्धसैनिक बल है जो भारत की एक्सटर्नल इंटेलीजेंस एजेंसी रिसर्च ऐंड एनालिसिस विंग (रॉ) के तहत काम करती है. वर्मा ने कंपनी के अमेरिकी आकाओं को दिसंबर, 2011 को भेजे एक ई-मेल में बताया था, “एसएफएफ भारत का प्रमुख अर्धसैनिक संगठन है. वे जो भी खरीदेंगे,  बाकी भी उसे ही खरीदेंगे.”

एसआइजी और बरेटा के अलावा तीन अन्य ग्लोबल फर्म ने सेना के टेंडर में रुचि दिखाई हैः अमेरिका की कोल्ट डिफेंस, चेक रिपब्लिक की सेस्का ब्रयोफ्का और इज्राएल की इज्राएली वेपन इंडस्ट्रीज (आइडब्ल्यूआइ). बताया जाता है कि इज्राएली कंपनी को लंदन के एक बड़े हथियार डीलर का समर्थन है. एसआइजी दिग्गजों के भारत दौरे के कुछ समय बाद ही जनवरी में गृह मंत्रालय, रक्षा मंत्रालय और गृह तथा रक्षा सचिवों के पास कई अज्ञात स्रोतों से शिकायतों की झड़ी लग गई. शिकायत में 36 प्वाइंट साइज में लिखा थाः “बीएसएफ  के लिए 9 एमएम कारबाइन, एक और घोटाला.” इसमें आगे लिखा था, “बरेटा-भूपिंदर सिंह (टस्की)”, गृह मंत्रालय ने किसी एजेंट को किसी हथियार उत्पादक का प्रतिनिधित्व और लॉबी करने की इजाजत कैसे दी. इस तरह की शिकायत के सभी सात पेजों पर एक ही पंक्ति लिखी थीः “गृह मंत्रालय में कामयाबी हासिल करने के बाद अब बरेटा का अंतिम निशाना रक्षा मंत्रालय होगा.”

कहा जा रहा है कि इन शिकायतों की बौछार के पीछे वर्मा का हाथ है. जनवरी अंत तक वह खुद परेशानियों से घिर गया. आकर्षक सौदे के विफल रहने से चिढ़े वर्मा के पूर्व साझेदार न्यूयॉर्क के एक वकील सी. एडमंड एलन ने सीबीआइ, रक्षा मंत्रालय और गृह मंत्रालय को पत्र लिखकर ज्यूरिख स्थित स्विस हथियार कंपनी रीनमेटल एयर डीफेंस (आरएडी) के 5,30,000 डॉलर (3 करोड़ रु.) का भुगतान करने के बारे में जानकारी दी. उसने इस सौदे के सबूत के तौर पर कुछ दस्तावेज भी साथ भेजे थे. आरएडी के अधिकारी कथित रूप से वर्मा से यह चाहते थे कि 2011 में उनको जिस ब्लैक लिस्ट में शामिल कर दिया गया था उससे बाहर किया जाए. 2009 में आर्डनेंस फैक्टरी बोर्ड (ओएफबी) के घूस मामले में लिप्त पाए जाने पर उन्हें ब्लैक लिस्टेड किया गया था.
हालांकि, आरएडी ने भारत में ऐसे किसी भी भ्रष्टाचार के मामले में शामिल होने के आरोपों का खंडन करते हुए अपने बयान में कहा था, “ये आरोप झूठे और निराधार हैं.” वर्मा और नेयाक्सू पर भ्रष्टाचार के आरोप लगाए गए और सीबीआइ ने उन्हें जून में गिरफ्तार कर लिया. सीबीआइ ने चार्जशीट दाखिल नहीं की जिससे वर्मा को जमानत मिल गई. उसे सीबीआइ ने फिर जालसाजी के लिए गिरफ्तार किया और 60 दिन की अनिवार्य अवधि के भीतर वह फिर चार्जशीट दाखिल करने में नाकाम रही. वर्मा फिर रिहा हो गया.

आखिरकार उसे रक्षा मंत्रालय के गुप्त दस्तावेज और खरीद योजना रखने के आरोप में सरकारी गोपनीयता कानून के तहत 30 अगस्त को फिर गिरफ्तार कर लिया गया. वर्मा के वकील विजय अग्रवाल ने इन आरोपों को गलत बताया. उन्होंने मेल टुडे से 29 जुलाई को कहा था, “मैं यही कह सकता हूं कि हर दिन कुछ-न-कुछ नया कहा जा रहा है जो निश्चित रूप से कोर्ट की कार्यवाही को प्रभावित करने की कोशिश है. यह टिप्पणी करने के लिए सही समय नहीं है.”

सेना के टेंडर के बारे में भी यह आरोप लगाया गया है कि यह बेरेटा को लाभ पहुंचाने के हिसाब से तैयार किया गया था. दुनिया की दो सबसे बड़ी राइफल निर्माता कंपनियां बेल्जियम की एफएन हरस्टाल और जर्मनी की हेकलर ऐंड कोच 2011 में हुई नीलामी में शामिल नहीं हुईं क्योंकि उन्हें इसमें जीत का भरोसा नहीं था.
सेना ने आजादी के बाद सिर्फ दो बार अपनी राइफलों को बदला है—1962 के चीन युद्ध के बाद और 1999 में करगिल युद्ध के आसपास. मौजूदा स्वदेशी 5.56 एमएम के इनसास राइफलों को लेकर सेना अपना असंतोष जताती रही है. सेना 7.62 एमएम एके-47 राइफलों से भी बेहतर राइफल चाहती है.

इन एके-47 राइफलों का इस्तेमाल जम्मू-कश्मीर और पूर्वोत्तर में आतंकवाद से निबटने में होता रहा है. सेना को मिले नए हथियार से 7.62 एमएम और 5.56 एमएम,  दोनों तरह की गोलियां दागी जा सकती हैं. इससे सैनिक किसी लक्ष्य को साधने के लिए बैरल बदलने में सक्षम होता है. इस क्षमता के लिए भारी कीमत चुकानी पड़ रही है. कनवर्जन किट के साथ हर राइफल करीब 3,000 यूरो (करीब 2,00,000 रु.) कीमत की पड़ती है जबकि ओएफबी में बने इनसास राइफल की कीमत सिर्फ 35,000 रु. होती है.

यह अभी साफ  नहीं हो पाया है कि यह टेंडर जारी करने से पहले सेना ने आखिर किस तरह की डील की है. इस ठेके को लेकर खुद सेना में भी अलग-अलग राय है. एक जनरल ने कहा, “दुनिया में कोई भी सेना ऐसे महंगे और जटिल हथियार का इस्तेमाल नहीं करती. इससे सैनिकों पर बोझ और बढ़ेगा, साथ ही इसे ढोना भारी साबित होगा.

मल्टी-कैलिबर हथियार आम तौर पर कमांडो जैसे विशेषज्ञ यूनिट को ही सप्लाई किए जाते हैं.” एसआइजी ने अपने भारतीय कारोबार से वर्मा और नेयाक्सू को बाहर कर दिया है और अब वह सेना के ठेके की दौड़ में शामिल हो गई है, जिसके लिए परीक्षण जल्दी ही किया जाना है. वर्मा के मैदान में न रहने का मतलब है कि दुनिया के सबसे बड़े बंदूक ठेके के लिए प्रतिस्पर्धा सिर्फ एक अहम खिलाड़ी तक सिमट गई है.

महाराष्‍ट्र में बाल विकास योजना के 1000 करोड़ डकार गए ठेकेदार

महाराष्ट्र में एक और घोटाला सामने आया है और ये घोटाला है 1 हजार करोड़ रुपए का. खाद्य सुरक्षा पर चल रही सरकारी योजनाओं की निगरानी के लिए नियुक्त सुप्रीम कोर्ट के कमिश्नर ने केंद्र सरकार की बाल विकास योजना में हुए इस घोटाले का खुलासा किया है.

कमिश्नर की रिपोर्ट के मुताबिक निजी कंपनियों ने वहां फर्जी महिला मंडल बना कर पूरी योजना पर कब्जा कर लिया. रिपोर्ट के मुताबिक महाराष्ट्र में 1000 करोड़ की बाल विकास योजना पर ठेकेदारों ने कब्जा कर लिया है.

पूरे घोटाले की जानकारी कमिश्नर और नेशनल कमीशन फॉर प्रोटेक्शन ऑफ चाइल्ड राइट्स ने महाराष्ट्र के मुख्यमंत्री को दी थी लेकिन फिर भी कुछ नहीं हुआ.

रक्षा भूखंड घोटाले - फौजी जमीन पर कब्जा करने के पांच तरीके

मात्र तीन वर्षों में 1,073 एकड़ यानी 412 फुटबॉल मैदानों के बराबर फौजी जमीन को बिल्डर और प्राइवेट डेवलपर अतिक्रमण के जरिए हड़प चुके हैं. मार्च, 2011 में सरकार यह बात बिना राग-द्वेष के स्वीकार कर चुकी है. सरकार ने आंकड़े उपलब्ध कराए थे कि सैनिक क्षेत्रों में अतिक्रमण 3510.16 एकड़ से बढ़कर 4,583.58 एकड़ हो चुका है. सैन्य संपदा महानिदेशालय (डीजीडीई) ने अपनी सीधे स्वामित्व वाली 66,000 एकड़ भूमि पर इन अतिक्रमणों की सूचना दी थी.

डीजीडीई रक्षा मंत्रालय में वह विभाग है, जो अतिक्रमण के खतरे वाली 20 लाख करोड़ रु. मूल्य की 17 लाख एकड़ से ज्‍यादा जमीन के ऑडिट, लेखांकन और वित्तीय प्रबंधन के लिए जिम्मेदार है. इसमें से लगभग 11,000 एकड़ जमीन चुराई जा चुकी है और किसी को इसकी परवाह नहीं है. हजारों करोड़ रु. मूल्य की जमीन के रिकॉर्ड सुरक्षित इलेक्ट्रॉनिक डाटाबेस के बजाए जीर्ण-शीर्ण कागज के रजिस्टरों में दर्ज हैं. इस जमीन का सीमांकन नहीं हुआ है और इससे भी खराब बात यह है कि सेना के अधिकारियों, डिफेंस एस्टेट के अधिकारियों और बिल्डरों की एक भ्रष्ट सांठगांठ इस जमीनी पूंजी में से मोटा हिस्सा हड़प लेती है.

डीजीडीई के पास सैन्य भूमि को संभालने के लिए 1,251 अधिकारी हैं, लेकिन इसकी सुरक्षा कर सकने में नाकाम रहने के लिए किसी को भी जिम्मेदार नहीं माना गया है. रक्षा मंत्रालय को अपना प्रस्तावित रक्षा भूमि प्रबंधन विधेयक संसद में पेश करना अभी बाकी है. अगर फौजी जमीन को लूटने के लिए कोई घोटालेबाज अपना मैनुअल बनाए, तो वह कुछ इस प्रकार होगाः

1. कमजोर नस वाले रक्षा और सैन्य अधिकारियों की पहचान.
कमोबेश सभी भूमि घोटालों में अफसरों की सांठगांठ देखने को मिली है
इकत्तीस जनवरी को सीबीआइ ने सेना के पूर्व उप-प्रमुख लेफ्टिनेंट जनरल (रिटा.) नोबेल थंबुराज के घर पर एक भूमि घोटाले में उनकी कथित भागीदारी के सिलसिले में छापा मारा. सेना की एक प्रेस विज्ञप्ति में कहा गया कि थंबुराज ने एक बिल्डर के साथ अदालत के बाहर एक समझैता किया था, जिसके परिणामस्वरूप सरकार को पुणे छावनी क्षेत्र में 45 करोड़ रु. मूल्य की बेशकीमती 0.96 एकड़ जमीन गंवानी पड़ी थी. पिछले पांच वर्षों में उजागर अधिकांश सैन्य भूमि घोटालों में डिफेंस एस्टेट अधिकारियों की सेना अधिकारियों और निजी डेवलपरों के साथ सांठगांठ पाई गई है. कारण जानने के लिए बहुत गहराई में झंकने की जरूरत नहीं. सैनिक अड्डों पर डीजीडीई का प्रतिनिधित्व डिफेंस एस्टेट के अधिकारियों द्वारा किया जाता है. ये अधिकारी  फौजी जमीन के संरक्षक होते हैं. भूमि का इस्तेमाल सेना करती है. देश भर के सभी 62 छावनी बोर्डों में स्थानीय प्रशासन का नेतृत्व उस सैनिक क्षेत्र का जनरल ऑफिसर कमांडिंग करता है. छावनी क्षेत्र के भीतर इमारतों के निर्माण की अनुमति बोर्ड देता है.

2. उस जमीन को निशाना बनाओ, जो सैन्य रिकॉर्ड में दर्ज न हो
घोटालेबाज जमीन के दस्तावेज कमजोर होने का लाभ उठाते हैं
कुल फौजी जमीन का 25 फीसदी ऐसा है जिसका ब्यौरा डिफेंस एस्टेट डिपार्टमेंट के भूमि रिकॉर्ड में दर्ज नहीं है. इसके लिए सुस्त अफसरशाही दोषी है. जब लैंड-होल्डिंग अस्पष्ट होती है, तो यह जमीन हड़पने वालों द्वारा नोचे जाने के लिए ज्‍यादा मुफीद हो जाती है.

उदाहरण के लिए आदर्श घोटाले में, जो हाउसिंग सोसाइटी रिटायर्ड सैन्य अधिकारियों और डिफेंस एस्टेट के अधिकारियों ने बनाई थी, उसने दक्षिण मुंबई के कोलाबा में फुटबॉल के मैदान के आकार के बेशकीमती भूखंड पर मकान बना डाले. जमीन सेना के पास थी, लेकिन स्वामित्व राज्‍य सरकार के पास था. कोई रिकार्ड उपलब्ध ही नहीं था. डिफेंस एस्टेट और सैन्य अधिकारियों की जुगलबंदी ने आगे बढ़कर एक वाणिद्गियक रिहायशी टॉवर बना डाला.

3. फौजी जमीन पर दबे पैर अतिक्रमण करो
बिल्डर चारों ओर के निजी भूखंड खरीदकर रक्षा भूमि की घेराबंदी कर लेते हैं
रक्षा भूमि इस्तेमाल में नहीं आती, उसकी अमूमन बाड़ भी नहीं लगाई गई होती है. देखा गया है कि कई बार जमीन हड़पने वाले खाली पड़ी रक्षा भूमि के चारों ओर की निजी भूमि खरीद लेते हैं और फिर धीरे-धीरे रक्षा भूमि को घेर लेते हैं. यह काम 2009 में उजागर हुए श्रीनगर वायुसेना भूमि घोटाले के मामले में किया गया. 1500 करोड़ रु. से ज्‍यादा की लगभग 200 एकड़ बेशकीमती रक्षा भूमि चोरी छिपे कई वर्षों में बेच दी गई.

डिफेंस एस्टेट के अधिकारी यह दिखाने के लिए अनापत्ति प्रमाणपत्र जारी कर देते थे कि यह जमीन रक्षा मंत्रालय की कभी थी ही नहीं, जबकि रक्षा मंत्रालय ने इसे 1966 में ही खरीदा था. इसी तरह एक अंग्रेजों के जमाने से चली आ रही चीज है, कैंपिंग ग्राउंड, जो सैनिक क्षेत्रों के बाहरी इलाकों की तरफ होता है. इसे भी शिकार के लिए एकदम उपयुक्त माना जाता है.

डीजीडीई से अपेक्षा की जाती है कि वह अपने लैंड-बैंक की स्थिति परखने के लिए जमीन का ऑडिट करेगा. आखिरी बार बड़े पैमाने पर ऑडिट सन्‌ 2000 में किया गया था. विभाग हर वर्ष अपने कब्जे वाली जमीन का पहले से कम आकलन पेश कर देता है. अतिक्रमणों को 'एक जटिल सामाजिक-आर्थिक समस्या' करार दे दिया गया है. विवादित भूखंडों के सर्वे, जिनका आदेश समय गुजारने के लिए दे दिया जाता है, राज्‍य सरकार के साथ मिलकर किए जाते हैं और इनमें पांच वर्ष से भी ज्‍यादा समय लग सकता है.

जमीन की सुरक्षा की जिम्मेदारी में घालमेल हो जाता है और जमीन का स्वामित्व भी अस्पष्ट होता है. दोषी अधिकारियों को सिर्फ तब सजा मिलती है, जब सार्वजनिक तौर पर भारी शोर-शराबा हो गया हो. सीबीआइ अभी तीन रक्षा भूमि घोटालों की जांच कर रही है-आदर्श, कांदिवली और लोहेगांव, पुणे. 2011 में उजागर हुए लोहेगांव भूमि घोटाले में, तीन घोटालेबाजों ने 800 करोड़ रु. की 69 एकड़ फौजी जमीन के स्वामित्व का दावा करने वाले फर्जी दस्तावेज तैयार कर लिए थे.

4. ओल्ड ग्रांट बंगलों को निशाना बनाएं
खरीदार पेशकश करते हैं कि वे पुराने मकान तोड़कर उस जगह नई रिहाइशी इमारत बनवाएंगे
ओल्ड ग्रांट बंगले अंग्रेजों के जमाने के मकान हैं, जो बेशकीमती सरकारी जमीन पर बने होते हैं. ज्‍यादातर सैनिक अड्डे और छावनियां इन बंगलों से पटी पड़ी हैं. अब वे   बेशकीमती हैं, क्योंकि वे जिस जमीन पर खड़े हैं, वह बेशकीमती हो गई है. इस जमीन का स्वामित्व सरकार का होता है.

तरीका यह होता है कि बिल्डर मूल किराएदारों के पास पहुंचता है और उन्हें पैसे देकर अपने पक्ष में कर लेता है. बंगलों को 'डी-हायर' किया जाता है-यानी वह प्रक्रिया जिसमें सरकार किराया वसूलना बंद कर देती है. इसके बाद बिल्डर छावनी बोर्ड से संपर्क करता है और उससे 'जीर्ण-शीर्ण' इमारत को ढहाने और उसकी जगह एक नई रिहाइशी इमारत बना देने की पेशकश करता है.

2011 में भारत के नियंत्रक और महालेखा परीक्षक के किए गए ऑडिट में लखनऊ, अल्मोड़ा, कानपुर, रानीखेत और बरेली में सैन्य क्षेत्रों में ऐसे 16 बंगलों का उल्लेख इस रूप में है कि इन्हें 150 करोड़ रु. में अवैध ढंग से बेचा गया है. ऐसे कई और मामले भी ऑडिट अधिकारियों की निगाह से गुजर रहे हैं. मेरठ छावनी में, पुराने ग्रांट बंगलों की जगह पर स्कूल, कॉलेज और रिहाइशी इमारतें बना दी गई हैं. 2010 की सीएजी रिपोर्ट में इस बात का जिक्र किया गया है कि पुणे छावनी में किस तरह एक पुराने ग्रांट बंगले के स्थान पर रेजिडेंसी क्लब बना दिया गया.

5. फौजी जमीन के स्वामित्व को अदालत में चुनौती दो
चूंकि बचाव पक्ष कानूनी तौर पर कमजोर है, सो अदालती प्रक्रिया लंबी खिंचेगी
डीजीडीई की सबसे कमजोर नस है अतिक्रमण की चपेट में आई रक्षा भूमि का अदालत में बचाव कर सकने में उसकी नाकामी. अनुमान है कि रक्षा भूमि को लेकर विभिन्न अदालतों में करीब 13,000 मामले लंबित चल रहे हैं. इन मामलों से जिस ढंग से निबटा जा रहा है, वह चिंताजनक है. सरकार लंबित मामलों की सुनवाई के दौरान समय पर अपने जवाब दर्ज नहीं करवाती है और अदालत की प्रक्रिया दशकों तक खिंचती जाती है. कंट्रोलर जनरल ऑफ डिफेंस एकाउंट्स (सीजीडीए) द्वारा तैयार की गई एक रिपोर्ट में सुझाव दिया गया है कि डिफेंस एस्टेट विभाग के पास उनके मुकदमे लड़ने के लिए एक पृथक कानूनी विभाग होना चाहिए. इस सुझाव पर किसी ने गौर नहीं किया.

रक्षा मंत्रालय के एक अधिकारी कहते हैं, ''डिफेंस एस्टेट के अधिकारी खुद को हालात के मारे की तरह पेश करते हैं. भ्रष्ट अधिकारियों को यही जंचता है कि सरकार की तरफ से अदालत में कमजोर कानूनी बचाव पेश किया जाए, ताकि वे मुकदमा हार जाएं.''

सीजीडीए के अधिकारी कहते हैं कि देश भर में कानूनी विवादों में 'हजारों करोड़ रुपयों' की जमीन फंसी पड़ी है. इस मामले में गौर करने लायक एक मामला है सिकंदराबाद में रक्षा भूमि पर छह एकड़ का एक भूखंड, जिस पर रक्षा लेखा विभाग ने मकान बनाए हैं. 2002 में हाइकोर्ट का फैसला एक निजी फर्म के पक्ष में गया. लेकिन रक्षा मंत्रालय ने इस फैसले के खिलाफ अपील की और मामला सुप्रीम कोर्ट में चल रहा है.

इस मामले में मंत्रालय के समक्ष जो विकल्प हैं, वे काफी गंभीर हैं. या तो उसे सारी इमारतें ढहाकर जमीन निजी सोसायटी को लौटानी होगी, या जमीन की बाजार कीमत के तौर पर 100 करोड़ रु. चुकाने होंगे.

रक्षा सौदे घोटाले - रक्षा खरीदारी का अंधकार

बात अगस्त 2009 की है. दिल्ली में एक ऐसा शख्स उतरा जिससे आम तौर पर कभी किसी खुलासे की बात नहीं सुनी गई. कर्नाटक से कांग्रेस के पूर्व सांसद 79 वर्षीय एच. हनुमंतप्पा राजधानी में एक चिट्ठी लेकर आए थे जिसमें रक्षा मंत्रालय द्वारा चेक गणराज्‍य में बनी टाट्रा ट्रकों की खरीद के तरीके में कथित गड़बड़ी के आरोप लगाए गए थे. उनके पास एक गोपनीय रिपोर्ट भी थी जिसे भारत अर्थ मूवर्स लिमिटेड (बीईएमएल) के एक कर्मचारी ने तैयार किया था.

रिपोर्ट में आरोप लगाया गया था कि बंगलुरू स्थित रक्षा क्षेत्र की इस सार्वजनिक इकाई ने ट्रकों की खरीद में रक्षा खरीद नियमों का उल्लंघन करते हुए इसे मूल निर्माता से खरीदने की बजाए ब्रिटेन के एक एजेंट रविंदर कुमार ऋषि से खरीदा. उनके मुताबिक, ट्रकों की कीमत को बढ़ा-चढ़ाकर दिखाया गया था. इन्हें 40 से 80 लाख रु. प्रत्येक की कीमत पर मंगवाया गया, लेकिन बीईएमएल ने इसे दोगुने दाम पर रक्षा मंत्रालय को बेचा. यानी 100 फीसदी से ज्‍यादा का फायदा.

इस सौदे पर बजी खतरे की यह पहली घंटी नहीं थी. पहले भी आशंकाएं जाहिर की गई थीं कि रक्षा मंत्रालय मूल उपकरण निर्माता के साथ सौदा करने की बजाए ट्रेडिंग कंपनी के साथ सौदा कर रहा है. गौर तलब है कि 2006 से रक्षा मंत्रालय की खरीद प्रक्रिया में मूल उपकरण निर्माताओं से सौदा करने को अनिवार्य बना दिया गया है.

2005 में ब्रिगेडियर आइ.एम. सिंह ने टाट्रा ट्रकों की खरीद में कथित अनियमितताओं का आरोप लगाया था. वे मास्टर जनरल ऑफ ऑर्डनेंस (एमजीओ) में तैनात थे. एमजीओ विभाग सेना के लिए वाहन और शस्त्र खरीदने के लिए जिम्मेदार होता है. यह आरोप लगाने के बाद बिग्रेडियर आइ.एम. सिंह को एमजीओ से हटा दिया गया. उसी साल एक टीवी चैनल ने इस सौदे पर खबर भी दी थी और सवाल उठाया था कि कोई सार्वजनिक क्षेत्र की इकाई किसी सब्सिडियरी के साथ सीधे सौदा कैसे कर सकती है.

साल भर बाद 2006 में निजी क्षेत्र की दो रक्षा कंपनियों लार्सन ऐंड टूब्रो और टाटा पावर को डीआरडीओ की एक संयुक्त परियोजना में काम करने के दौरान बीईएमएल से 28 टाट्रा ट्रकों की जरूरत पड़ी जिन पर स्वदेश निर्मित पिनाका रॉकेट तैनात किए जाने थे. बीईएमएल ने दोनों कंपनियों से आरंभिक 80 लाख रु की राशि पर अतिरिक्‍त 40 लाख रु. प्रति ट्रक की मांग की, जिसे उन्होंने देने से मना कर दिया.

मार्च, 2010 में रक्षा मंत्रालय ने ऋषि की कंपनी ग्लोबल वेक्ट्रा से अतिरिक्त 788 ट्रक 40 फीसदी अधिक दाम पर खरीदे. पिछले 25 साल के दौरान ऐसे 7,000 टाट्रा ट्रकों की खरीद पर 5,000 करोड़ रु. से ज्‍यादा खर्च किए जा चुके हैं. इन सबके बावजूद 30 मार्च को जाकर सीबीआइ पहली बार एफआइआर दर्ज कर सकी, जिसमें देश को धोखा देने के मामले में ऋषि को प्रमुख आरोपी बनाया गया है.

रक्षा मंत्री ए.के. एंटनी यदि दो महीने में रिटायर होने वाले सेना प्रमुख जनरल वी.के. सिंह के दबाव में नहीं आते, तो शायद यह कार्रवाई नहीं होती. जनरल वी.के. सिंह सैन्य बलों में फैल चुके भ्रष्टाचार से तंग आ चुके थे.

पिछली 26 मार्च को एक अखबार में उन्होंने इंटरव्यू में कहा था कि 600 घटिया वाहनों की खरीद को मंजूरी देने के बदले उन्हें 14 करोड़ रु. की रिश्वत की पेशकश की गई थी.

सेना प्रमुख के मुताबिक, सितंबर, 2010 में अवकाशप्राप्त लेफ्टिनेंट जनरल तेजिंदर सिंह ने उन्हें यह पेशकश की थी. अप्रैल में सीबीआइ से की गई औपचारिक शिकायत में जनरल वी.के. सिंह ने ऋषि को जिम्मेदार ठहराया है जिसकी ओर से तेजिंदर रिश्वत की पेशकश करने आए थे. सीबीआइ ने अब इस आरोप में प्राथमिक जांच शुरू कर दी है.

टाट्रा सौदा रक्षा खरीद में दलाली की बस एक झलक भर है, जहां हिथयारों के महत्वाकांक्षी एजेंट, भ्रष्ट अफ सर और आसानी से पटाए जा सकने वाले नेताओं में गहरी साठगांठ है. सरकारी कागजों में वैसे तो अगस्त, 2006 से ही हथियारों के एजेंट गायब हो चुके हैं. उस वक्त रक्षा कंपनियों को एक सत्यनिष्ठा समझौते पर दस्तखत करने थे जहां उनसे हलफनामा लिया गया था कि वे रिश्वत नहीं देंगी और एजेंट नहीं रखेंगी.

निर्माताओं के लिए प्रावधान था कि यदि उन्होंने एजेंट का इस्तेमाल किया, तो उन्हें ब्लैकलिस्ट कर दिया जाएगा. इस सबके बावजूद दलाल अब भी फल-फूल रहे हैं जिन्हें 'कामयाबी की रकम' के तौर पर 10 फीसदी कमीशन दिया जा रहा है. दलाली के पैसे को वकीलों की फीस, अवकाश प्राप्त सैन्य अधिकारियों के परामर्श शुल्क और इवेंट मैनेजमेंट कंपनियों के शुल्क जैसे आवरणों से ढंक दिया जाता है. रक्षा विश्लेषक सी. उदय भास्कर कहते हैं, ''रक्षा उपकरण खरीदने से जुड़ी हमारी अफसरशाही और गोपनीय प्रक्रिया भ्रष्टाचार को बढ़ावा देती है.''

बहरहाल, देश में अब यह एक बड़ा कारोबार बन चुका है. भारत दुनिया का सबसे बड़ा हथियार आयातक है. इसने 2007 और 2011 के बीच 60,000 करोड़ रु. (12 अरब डॉलर) के हथियार आयात किए हैं. अगले दशक में यह आंकड़ा 5 लाख करोड़ रु. (100 अरब डॉलर) को पार कर जाएगा. जो सौदे पाइपलाइन में हैं उनमें 126 रफेल लड़ाकू विमानों की 90,000 करोड़ रु. में खरीद, 50,000 करोड़ रु. में छह पनडुब्बियों और अनुमानतः 20,000 करोड़ रु. में की जाने वाली 2,700 हॉवित्जर की खरीद शामिल है. इन्हें बेचने वालों में अमेरिका, फ्रांस, रूस, इज्राएल और ब्रिटेन के सैन्य-औद्योगिक प्रतिष्ठान शामिल हैं.

आखिरकार सिलसिलेवार ढंग से हुए रक्षा घोटालों का साया एंटनी पर पड़ ही गया जिनके अधिकार क्षेत्र में आठ सार्वजनिक क्षेत्र की रक्षा इकाइयों और 40 आयुध कारखानों की खरीद प्रक्रिया आती है. वे पारंपरिक वामपंथी रुझान वाले कांग्रेसी हैं, जो हमेशा से सार्वजनिक क्षेत्र के पैरोकार रहे हैं और उनका राजनैतिक करियर काफी साफ-सुथरा रहा है. अब ऐसा लग रहा है कि उन्होंने कुछ संदिग्ध हथियार सौदों की ओर से अपनी आंखें मूंद रखी थीं.

2009 में सीबीआइ ने आयुध फैक्टरी बोर्ड के पूर्व अध्यक्ष और प्रबंध निदेशक सुदीप्तो घोष को गिरफ्तार किया था. आयुध फैक्टरी बोर्ड रक्षा मंत्रालय के तहत आने वाली 40 फैक्टरियों पर नियंत्रण रखने वाली शीर्ष इकाई है. घोष ने कथित तौर पर दो भारतीय और चार विदेशी कंपनियों से रिश्वत ली थी जिन्हें 5 मार्च को एंटनी ने ब्लैकलिस्ट कर दिया था.

एंटनी के मुताबिक, यह प्रतिबंध सीबीआइ की सलाह पर लगा था, जिसने इन कंपनियों के खिलाफ सुबूत जुटा लिए थे.

हालांकि यह प्रतिबंध भारत में विशाल रक्षा सौदों के बाजार में मोटा हिस्सा हड़पने के लिए जबरदस्त लॉबीइंग को नहीं रोक पाया. सरकार भारतीय वायु सेना के लिए कई अरब डॉलर में 126 नई पीढ़ी के लड़ाकू जेट खरीदने का सौदा करने ही वाली थी कि उसके एक पखवाड़े पहले 31 जनवरी को एक फ्रांसीसी हथियार कंसल्टेंट बर्नाड बैएको दिल्ली पहुंचा. उसे रक्षा अधिकारियों के साथ बातचीत में हिस्सा लेना था. लंदन से छपने वाले अखबार संडे टाइम्स ने इस दौरान एक खबर छापी जिसका शीर्षक था 'इनसाइड अ 18 बिलियन डॉग फाइट.'

खबर में बताया गया था कि बैएको थैलेज नाम की एक रक्षा फ र्म का पूर्व कर्मचारी था जो रफव्ल को रडार और इलेक्ट्रॉनिक प्रणाली मुहैया कराती है. खबर में बताया गया था कि बैएको जीआइई रफेल यानी लड़ाकू  जेट बनाने वाली 500 कंपनियों के एक कंसोर्शियम की गठित टीम का हिस्सा था.

2जी घोटाले में अपनी पड़ताल से देश को हिला कर रख देने वाले जनता पार्टी के अध्यक्ष सुब्रमण्यम स्वामी के मुताबिक बैएको की भूमिका काफी प्रभावशाली थी. स्वामी ने इंडिया टुडे को बताया, ''वह दिल्ली में करीब एक हफ्ते रहा और कई अहम लोगों से मिला. मुझे बताया गया था कि 126 मध्यम लड़ाकू विमानों की आपूर्ति के लिए 90,000 करोड़ रु. का ठेका यूरो फाइटर को (जो इटली, जर्मनी और ब्रिटेन के कंसोर्शियम ईएडीएस का उत्पाद है) तकरीबन मिल ही गया था कि अचानक सब कुछ पलट गया और सौदा डेसॉल्ट के हाथ लगा.''

कहानी यहीं खत्म नहीं होती. सुरक्षा मामलों की कैबिनेट समिति (सीसीएस) ने वायु सेना के लिए 75 प्रशिक्षक विमानों की खरीद के 1,850 करोड़ रु. के सौदे को लटका दिया था. सीसीएस ने इस मामले में रक्षा मंत्रालय से सफ ाई मांगी थी. दरअसल, हुआ यह था कि दक्षिण कोरियाई सरकार की ओर से आधिकारिक शिकायत प्रधानमंत्री कार्यालय को मिली थी, जिसमें कंपनियों की चयन प्रक्रिया पर उंगली उठाई गई थी. दावेदारों में दक्षिण कोरिया की कोरियन एयरोस्पेस इंडस्ट्रीज (केएआइ) भी शामिल थी. उसकी टक्कर स्विट्जरलैंड की हवाई क्षेत्र की विशाल कंपनी पाइलेटस एयरक्राफ्ट लि. से थी.

हुआ यूं कि पाइलेटस बोली में जीत गई और कोरियाई कंपनी दूसरे स्थान पर रही, जिसके बाद उसने बोली प्रक्रिया में गड़बड़ी का आरोप लगा दिया. उसका आरोप था कि स्विस कंपनी ने जिस कीमत पर बोली लगाई थी उसमें प्रौद्योगिकी के हस्तांतरण और रख-रखाव की लागत को जोड़ा नहीं गया था, जिससे उसकी बोली कम रही. आंध्र प्रदेश के एक सांसद अनंत वेंकटरामी रेड्डी ने दिसंबर, 2011 में प्रधानमंत्री को एक चिट्ठी में लिखा था, ''इसके चलते हमें (भारतीय वायु सेना) विमान के मालिकाना हक की कहीं ज्‍यादा लागत चुकानी पड़ेगी.''

रेड्डी ने पत्र में लिखा, ''इसके बावजूद रक्षा मंत्रालय के अधिकारियों ने तय किया कि वे रक्षा खरीद की तमाम प्रक्रियाओं को नजरअंदाज कर पाइलेटस का पक्ष लेंगे. वजह वे ही बेहतर जानते हैं. मुझे इतनी जानकारी है कि रक्षा मंत्रालय को बोली खुलने से पहले ही पाइलेटस की ओर से कई तरह के तकनीकी और वित्तीय आंकड़े प्राप्त हुए थे ताकि उनकी फाइलें दुरुस्त की जा सकें. यह पूरी तरह से रक्षा मंत्रालय के घोषित कायदों का उल्लंघन है.''

लगभग एक दशक में सीबीआइ ने हथियार के सौदागरों, रक्षा मंत्रालय के अधिकारियों और सैन्य अधिकारियों के खिलाफ 18 मामलों में चार्जशीट दाखिल की, लेकिन उसके हिस्से में कामयाबी बेहद मामूली रही. 2005 में लंदन स्थित एक बिचौलिए विपिन खन्ना और दिल्ली के हथियार दलाल मोहिंदर सिंह साहनी के खिलाफ  दक्षिण अफ्रीकी कंपनी डेनल से 1,200 एंटी मटीरियल राइफलें खरीदने में कमीशन खाने के मामले में चार्जशीट दाखिल की गई.

इसके साल भर बाद 2006 में बराक ऐंटी मिसाइल सिस्टम सौदे में रिश्वतखोरी के मामले में सुरेश नंदा के खिलाफ  चार्जशीट दाखिल की गई. यह सौदा इज्राएल एयरक्राफ्ट इंडस्ट्रीज और भारतीय सेना के बीच हुआ था. नंदा पर ही स्लोवाकिया से बख्तरबंद वाहनों के आयात में भी कथित रिश्वतखोरी का आरोप था.

इस मामले में सीबीआइ जांच अटकी पड़ी है क्योंकि इज्राएल और ब्रिटेन की ओर से न्यायिक जांच में सहयोग संबंधी आधिकारिक मंजूरी (लेटर रोगेटरी) हासिल नहीं हो सकी है. एजेंसी ने 2000 में हथियारों के दलाल सुधीर चौधरी के खिलाफ भी मामला दर्ज किया था, जिसने भारतीय युद्धपोतों पर सात बराक मिसाइलें तैनात करने के सौदे में कथित तौर पर दलाली खाई थी. बाद में सीबीआइ यह साबित नहीं कर सकी कि चौधरी के बैंक खातों में दुनिया के विभिन्न कोनों से आई राशि वास्तव में दलाली की कमीशन थी. हाल ही में उसके खिलाफ  फाइल बंद कर दी गई. हालांकि, प्रवर्तन निदेशालय अपने स्तर पर ऐसी ही एक जांच जारी रखेगा.

ठीक उसी साल सीबीआइ ने हथियारों के एक अन्य दलाल अभिषेक वर्मा के खिलाफ  मामला दर्ज किया गया था. वर्मा ने फ्रांसीसी कंपनी थैलेज की ओर से भारतीय नौ सेना को स्कॉर्पीन पनडुब्बी बिकवाने के मामले में बिचौलिए की भूमिका निभाकर भारी कमीशन ली थी. फिलहाल वर्मा जमानत पर हैं, लेकिन उनके खिलाफ मुकदमा जारी है. इस मामले में सीबीआइ के सामर्थ्य पर काफी कुछ निर्भर करता है कि वह वर्मा के सहयोगी रवि शंकरन का प्रत्यर्पण करवा पाती है या नहीं. शंकरन नौसेना वॉर रूम लीक मामले में प्रमुख संदिग्ध हैं.

2007 में हथियारों के सौदागर रवि ऋ षि की कंपनी ग्लोबल वेक्ट्रा हेलीकॉर्प एक घपले में फंस गई थी जिसके चलते भारतीय सेना के लिए यूरोकॉप्टर के 197 हेलीकॉप्टरों का अरबों रु. का सौदा रद्द हो गया था. रिटायर्ड ले. जनरल एस.जे.एस. सहगल ग्लोबल वेक्ट्रा हेलीकॉर्प के प्रमुख थे. सहगल वेक्ट्रा एविएशन के भी निदेशक थे जो यूरोकॉप्टर हेलीकॉप्टर की इकलौती वितरक है. रिटायर्ड सैन्य अधिकारियों के इस तरह के रूप में दिखने का इससे बेहतरीन उदाहरण नहीं मिलता.

सहगल के छोटे भाई ले. जनरल एच.एस. सहगल (उस समय सेवा में थे) उस वक्त बेल और यूरोकॉप्टर के बीच चयन की परीक्षण प्रक्रिया का हिस्सा थे. 3,000 करोड़ रु. का यह सौदा उस समय रद्द हो गया जब बेल ने रक्षा मंत्रालय को शिकायत कर दी कि सहगल बंधु मिलकर यह सौदा यूरोकॉप्टर को दिलवाने के पक्ष में माहौल बना रहे हैं.

एक बार फिर 30 मार्च को सीबीआइ ने ऋषि के खिलाफ टाट्रा ट्रक सौदे में एफआइआर दर्ज की है और उससे पूछताछ की जा रही है. टाट्रा की उपयोगिता को कोई चुनौती नहीं दे सकता. यूरोप की एक पर्वत श्रृंखला से इसका नाम प्रेरित है और इसका उपयोग टैंक, हॉवित्जर, रॉकव्ट और यहां तक कि अग्नि और पृथ्वी मिसाइलों को ले जाने में होता है. बोफोर्स की हॉवित्जर की तरह यहां गुणवत्ता का कोई सवाल पैदा नहीं होता है. इसकी एक प्रतिस्पर्द्धी कंपनी ने खुद अवरोधों पर इसकी मक्खन-सी चाल पर रश्क जाहिर किया था. जाहिर है सवाल गुणवत्ता का नहीं, भ्रष्टाचार और दाम बढ़ाकर बेचे जाने का है.

सीबीआइ ने बीईएमएल के'बेनाम' कर्मचारियों के खिलाफ  भी देश को चूना लगाने के मामले में आपराधिक साजिश का मामला दर्ज किया है. इस मामले में इस सार्वजनिक इकाई के चेयरमैन और प्रबंधन निदेशक वी.आर.एस. नटराजन से भी जवाब तलब किया गया है. बीईएमएल ने ऋषि की कंपनी ग्लोबल वेक्ट्रा के साथ सीधे सौदा करके नियमों का उल्लंघन किया है.

लेकिन नटराजन काफी सयाने हैं. उन्होंने केरल के पलक्काड में 260 करोड़ रु. के निवेश से एक फैक्टरी लगाई है जहां 500 से ज्‍यादा लोगों को रोजगार मिलेगा. केरल के पूर्व मुख्यमंत्री होने केनाते एंटनी का कर्तव्य बनता था कि वे अपने घर को सुरक्षित रखते. ऐसे विचारों से पूर्व रक्षा मंत्री प्रणब मुखर्जी को कोई फर्क नहीं पड़ता था, जिन्होंने अपने दो साल के कार्यकाल में अपने गृह राज्‍य पश्चिम बंगाल में रक्षा क्षेत्र की कोई सार्वजनिक इकाई नहीं लगाई.

सीबीआइ के अधिकारियों का कहना है कि जब ग्लोबल वेक्ट्रा ने मार्च 2003 में बीईएमएल के साथ सौदे पर दस्तखत किए थे तो उसने खुद को मूल उपकरण निर्माता बताया था, हालांकि वह चेक गणराज्‍य की ट्रक बनाने वाली एक फ र्म की एजेंट थी.

वेक्ट्रा समूह के वाइस प्रेसीडेंट (कम्युनिकव्शंस) दिलीप सिंह कहते हैं, ''रक्षा खरीद नियमों का कोई उल्लंघन नहीं हुआ है क्योंकि टाट्रा सिपॉक्स (ब्रिटेन) आधिकारिक वेंडर है जिसने रक्षा मंत्रालय को सीधे नहीं, बल्कि बीईएमएल को बिक्री की है.'' उन्होंने बताया, ''टाट्रा सिपॉक्स (ब्रिटेन) तकनीकी सहयोग और प्रौद्योगिकी हस्तांतरण के लिए बीईएमएल की एकल खिड़की जैसा काम करती है तथा चेक गणराज्‍य और स्लोवाकिया स्थित दोनों फैक्टरियों के लिए नए उत्पाद बनाती है. जाहिर है यह सिर्फ  'ट्रेडिंग कंपनी' नहीं है.''

माना जा रहा है कि ऋषि ने सीबीआइ की पूछताछ में कई ऐसे खुलासे किए हैं जिससे जांच का दायरा बढ़ सकता है और उसकी चपेट में उन अफसरशाहों और सैन्य अधिकारियों का एक जटिल नेटवर्क आ सकता है जिसे ऋषि ने 'पाला-पोसा.' विशेष तौर पर उसने एक अफसरशाह दंपती का जिक्र किया है जिससे अकूत संपत्ति बटोरने के मामले में पूछताछ चल रही है. ऐसा भी माना जा रहा है कि ऋषि की गिरफ्तारी हो सकती है. उसका पासपोर्ट पहले ही जब्त कर लिया गया है. प्रवर्तन निदेशालय और खुफिया राजस्व निदेशालय जैसी एजेंसियां उसकी एक से ज्‍यादा कंपनियों में पैसे के लेन-देन की जांच करेंगी.

तृणमूल कांग्रेस के सांसद अंबिका बनर्जी कहते हैं, ''लंबे समय से ऐसे दलाल भारत में फलते-फूलते रहे हैं और इन्होंने सैन्य बलों की गुणवत्ता के साथ खिलवाड़ किया है. रक्षा प्रतिष्ठान के करीब दुकानों से लेकर बड़े हथियार सौदों तक, दलाल हर जगह फैले हुए हैं.''

उन्होंने हाल ही में प्रधानमंत्री और रक्षा मंत्री पर आरोप लगाया था कि उन्होंने रक्षा क्षेत्र में भ्रष्टाचार पर लिखी उनकी तमाम चिट्ठियों की उपेक्षा की. ऐसी आखिरी चिट्ठी 11 मई, 2011 को लिखी गई थी. बनर्जी ने इन चिट्ठियों में सेना के लिए खोले जाने वाली दुकानों से लेकर हार्डवेयर की खरीद तक कई तरह के सौदों में रिश्वतखोरी की बात पर जोर दिया था.

एंटनी को रक्षा मंत्रालय की सफाई के लिए यूपीए सरकार में लाया गया था. आखिर, इस सरकार पर जिस कांग्रेस पार्टी और गांधी परिवार का नियंत्रण है, उसे पहले ही हथियार सौदों से काफी चोट पहुंच चुकी है. परिवार को भविष्य के लिए एक ऐसी विरासत की दरकार है जो बेदाग हो, न कि जिस पर बोफोर्स तोप सौदे जैसे छीटें हों. लेकिन अब तो टाट्रा के रूप में नई आफत आ गई है.

Bank Loans Scam: Banks start process to get back builders dues

Mumbai: Three years after Zoom Developers defaulted, a consortium of 25 state-owned banks have started the process to recover Rs 3,002 crore loan dues from the construction firm.

On Wednesday, United Bank of India along with 24 other banks issued an advertisement to auction properties given as security by Zoom, but now attached with the banks.

Among eight properties put on the market, two are at Andheri; a 3.4-acre plot in Chakala with a reserve price of Rs 21 crore and another a 900 sq mt plot in MIDC with a reserve price of Rs 11 crore. Their other properties are in Khopoli and Indore.

The banks have taken the action to attach collateral property after Zoom Developers, its promoters Vijay Choudhary and B L Kejriwal, and its guarantors failed to repay the said amount despite demand notices earlier this year.

There was no response to calls made on the office telephone number listed against Zoom by TOI.

Meanwhile, CBI has begun examining allegations of banking fraud in loans disbursed to Zoom.

CBI question banks on Rs 2,500 cr loan to Zoom DevelopersThe Central Bureau of Investigation (CBI) has begun preliminary examination of allegations of banking fraud in loans worth Rs 2,500 crore disbursed to Zoom Developers, a Mumbai-based project developer.

Confirming the approach made by CBI, two senior public sector bank executives said the agency had questioned banks on the borrower (company), which is already being treated as a non-performing account (NPA). There is also a question about the use of funds.

The CBI is acting on a complaint made to the government. The Reserve Bank of India  is also likely to get into act, since this is a case referred for debt restructuring, officials said.

Punjab National Bank  is lead banker to Zoom. In all, 27 Indian banks, most of these public sector ones, have lent Rs 2,500 crore to the company. Its loans were admitted for corporate debt restructuring in the fourth quarter of last year.

Bank guarantees given for Zoom have been invoked. Punjab National Bank is the lead banker, with about Rs 450 crore of exposure of which nearly Rs 300 crore has been considered as an NPA by the bank from the first quarter of this financial year.

A bank official said Rs 250 crore of the exposure is covered by insurance. The bank had taken insurance cover from Export Credit Guarantee Corporation of India Ltd. As for the defaults, all relevant departments, including vigilance and audit, are looking into the matter, he added.

The majority of Zoom’s projects are abroad, particularly in Europe and the UAE. It undertakes business and project development work, involving process plants, industrial and engineering projects, and energy, environment and infrastructure ones.

बेस्ट आवास घोटाला - बेस्ट यूनियन नेता के घोटाले पर शिकायतों का अंबार

- हाउजिंग घोटाला मामला, सेक्रेटरी 18 दिसंबर तक पुलिस हिरासत में

मुंबई ॥ दो करोड़ रुपये के हाउजिंग घोटाले में फंसे बेस्ट वर्कर्स इलेक्ट्रिक यूनियन के जनरल सेक्रेटरी विट्ठलराव गायकवाड़ के खिलाफ कई लोग सामने आए। सूत्रों से मिली जानकारी के अनुसार, सोमवार को भोईवाड़ा पुलिस स्टेशन में तकरीबन 20 से अधिक लोग गायकवाड़ के खिलाफ धोखाधड़ी पर अपना बयान दर्ज कराया। इन लोगों ने घर के लिए दिए गए पैसों की रीसिप्टि पुलिस स्टेशन में जमा कराई। ज्यादातर लोग मीडिया में गायकवाड़ की गिरफ्तारी की खबर पढ़कर सामने आए। इससे पहले इलेक्ट्रिक यूनियन के पूर्व सदस्य संजय घाड़ीगावकर ने गायकवाड़ के खिलाफ घर देने का लालच देकर पैसे जमा करने के खिलाफ शिकायत की थी।

भोईवाड़ा पुलिस ने 15 दिसंबर को गायकवाड़ को गिरफ्तार किया है। पुलिस ने उन्हें कोर्ट में पेश किया, जहां 18 दिसंबर तक पुलिस हिरासत में भेज दिया गया। बता दें कि गायकवाड़ ने पांच साल पहले कर्मचारियों के लिए हाउजिंग योजना शुरू की थी। इस बाबत लगभग 500 लोगों से 25-25 हजार रुपये लिया। हालांकि, इतना समय बीत जाने के बाद अब तक कर्मचारियों को घर नहीं मिला न ही उनके पैसे वापस किए गए। पुलिस गायकवाड़ की संपत्ति की भी जांच कर रही है और बैंक अकाउंट भी सील करने पर विचार कर रही है। कुछ महीने पहले ही गायकवाड़ की यूनियन से ही बेस्ट प्रशासन ने बिजली विभाग के कर्मचारियों के बाबत वेतन करार किया था।

मनपा नगरसेवकों का कार घोटाला - पैसे जनता के, सैर करें नगरसेवक

मुंबई।। बीएमसी के नियमानुसार यदि कोई नगरसेवक मुंबई के बाहर व्यक्तिगत दौरे पर आधिकारिक गाडि़यां ले जाता है तो , उसे पैसे चुकाने पड़ते हैं। हालांकि , हमारे जनप्रतिनिधि मेयर सुनील प्रभु , सभागृह नेता यशोधर फणसे और पूर्व स्थायी समिति अध्यक्ष रविंद्र वायकर समेत अन्य पांच पूर्व नगरसेवकों ने पैसे अब तक नहीं भरे हैं। बीएमसी ने तीन साल पहले 2008-09 में इन नगरसेवकों को व्यक्तिगत दौरे पर गाड़ी ले जाने बाद 8.62 लाख रुपये का बिल भेजा था।

15 नगरसेवकों के पैसे बकाया
बीएमसी अपने विभिन्न समिति अध्यक्ष और सदस्य नगरसेवकों को गाड़ी मुहैया कराती है। इन गाडि़यों का उपयोग मंुबई से बाहर अपने व्यक्तिगत काम के लिए करने पर प्रशासन इसके पैसे वसूलती है। तीन साल पहले 15 नगरसेवकों के दौरे के पैसे बकाया थे , लेकिन इनमें से आठ नगरसेवक ने अब तक पैसे नहीं चुकाए। इस सूची में सबसे बड़े नाम है शिवसेना नगरसेवक व मेयर सुनील प्रभु , पूर्व स्थायी समिति अध्यक्ष रविंद्र वायकर और सभागृह नेता यशोधर फणसे। सूत्रों से मिली जानकारी और एनबीटी के पास मौजूद बकाएदारों की सूची के मुताबिक , मेयर को 27,404 रुपये , वायकर को 11,912 रुपये और सभागृह नेता को 2,063 रुपये का बिल बीएमसी ने भेजा था।

बकाया लाखों में
वहीं , सबसे अधिक पैसे शिवसेना के पूर्व नगरसेवक प्रकाश चालके पर 4,09,916 रुपये और बीजेपी के पूर्व नगरसेवक विश्वनाथ म्हस्के पर 3,21,121 रुपये बकाया हैं। इस बारे में जब पूर्व स्थायी समिति अध्यक्ष व वर्तमान विधायक रविंद्र वायकर से पूछा गया तो उनका कहना था मेरा सारा दौरा आधिकारिक था। स्थायी समिति अध्यक्ष होने के नाते यह पैसे प्रशासन को भरने थे। सभागृह नेता फणसे ने कहा कि मैं कभी मुंबई से बाहर गया ही नहीं। यदि बीएमसी ने ऐसा कोई बिल भेजा है , तो उन्हें पड़ताल करनी चाहिए। विश्वनाथ म्हस्के का कहना था कि मेरा कोई पैसा बकाया नहीं है। मैं जब भी मंुबई के बाहर गया , ईंधन के पैसे दिए हैं। वहीं , मेयर सुनील प्रभु से संपर्क करने की कोशिश की लेकिन उनसे बातचीत नहीं हो पाई।

Irrigation Scam: Faulty design escalates cost of dam by 450cr

Mumbai: A faulty design was the ostensible reason for the cost of the Nerdhamana irrigation project in Akola district to skyrocket from an initial estimate of Rs 181 crore to Rs 638 crore.

State governor K Sankaranarayanan visited the project site on the Purna river earlier this month to supervise work. Experts said it is one of the most expensive irrigation projects in the country—Rs 9.18 lakh to irrigate one hectare of land as against the national average of Rs 1.70 lakh. Following the irrigation scam, TOI has learned that irrigation department officials have now proposed to reduce the project cost by 30%. Irrigation experts said this is a fit case for investigation by the state government-appointed special investigation team.
The water resources department justified the huge cost on the grounds that the project was innovative as it is being taken up in “soft black cotton soil’’. It also stated that the area was severely drought hit and in the suicide belt of Vidarbha region.

Contract cancelled following uproar in state assembly VIDC’s hasty tender process under lens
Mumbai: The cost of the Nerdhamana irrigation project in Akola has soared by over 250%.

The need for change of design was taken up after awarding of the project to the contractor.

The project is carried out under the supervision of the Vidarbha Irrigation Development Corporation (VIDC), an arm of the state water resources department, and is funded jointly by the Centre under the accelerated irrigation benefit project (AIBP).

The project received its first administrative approval (AA) on October 24, 2008 for an amount of Rs 181.99 crore. The tender process was initiated instantly and the work order was issued on March 2, 2009 for Rs 189.41 crore. In fact, a mobilization advance of 10% of estimated cost of project was also disbursed to the contractor. Work commenced and the scheduled date of completion was March 2012.

However, VIDC soon sought permission for a revised administrative approval (RAA), which substantially increased the cost to Rs 638.34 crore. The apparent reason given by the department was change in design of the barrage and its structures due to poor strata encountered at certain depths.

The need for change of design was taken up after awarding of the project to the contractor.

The advisory committee on irrigation, flood control and multipurpose projects in its 112th meeting held on September 14, 2011, and subsequent meetings, apprehended the unusual increase in the project cost. The revised estimate was given technical clearance by the central water commission in Delhi. However,the Centre has kept the funding pending following complaints from two MPs from Vidarbha regarding the astronomical increase in cost due to faulty design.

Questions are now being raised as to how VIDC initiated tender process hurriedly before finalizing the technicalities of the entire project. “The tender process was initiated based on tentative designs. VIDC should have waited till the final design was submitted since this was the first such project to be undertaken in different soil conditions,’’ said sources, who have tracked this project.

Correspondence between chief engineer, Special Projects, Amravati, to Barrage & Canal Design (N.W & N.W.S), shows that only the tentative design was prepared and final design was kept pending due to peculiar soil conditions.

“This proves that the state water resources department hurriedly initiated tender process without any technical sanction. Project work commenced in March, 2009, based on tentative designs,’’ said sources.
    Subsequently, the design wing of the central water commission sent a revised design around December 2009. “Since the revised design involved major cost variation from Rs 181.41 crore to 638.34 crore, it required a revised administrative approval. The state government should have waited for the actual design of the barrage and subsequently initiated tender process for the same. This would have saved hundreds of crores of rupees,’’ they added.
